AN ORDINANCE AMENDING CHAPTER 20 ARTICLE 5
OF THE MUNICIPAL CODE OF THE CITY OF SOUTH BEND,
INDIANA, 1971, BY THE ADDITION OF A NEW SECTION,
SECTION 20 -58.1 FOR THE DISPOSITION OF NON- MOVING
TRAFFIC VIOLATION FEES.
NOW, THEREFORE, BE IT ORDAINED by the Common Council of the
City of South Bend, Indiana:
SECTION I. Chapter 20 of the Code of South Bend, Indiana, 1971,
is hereby amended by the addition thereto of the following new Section:
"Sec. 20 -58.1 Fees"
Disposition.
"All fees collected for parking and other non - moving
violations under this Chapter 20, the disposition of
which is not otherwise specifically provided for by
law, shall be deposited in the special fund provided
for by IC 1971, 18- 6 -13 -1 et seq. (Burns' Stat. Secs.
48 -519 et seq.), and shall be appropriated and dis-
bursed therefrom in the same manner as license fees
and funds received from the parking meters."
SECTION II. This Ordinance shall be in full force and effect
from and after its passage by the Common Council, and its approval by the
Mayor.

SUBJECT: FEES COLLECTED FOR NON- MOVING PARKING VIOLATIONS
DATE: April 17, 1973
We are asking for this revision in the Municipal Code of South Bend so
that the fees collected for non- moving parking violations will be receipted
to the Parking Meter Fund. We feel that the Parking Meter Fund is the
proper place for these fees since they are derived from violations of the
parking meter operations, and the parking tickets are, for the most part,
issued by the Meter Maids; both of which are funded from the Parking
Meter Fund.
Of importance, also, is the parking garage bond ordinance provision which
mandates that all "un-obligated net revenues" of the Parking Meter Fund
be receipted to the Parking Sinking Fund. The Parking Meter Fund's cash
balance will be increased by receipting the money from parking violations
to it.
By receipting the fees from parking violations in the manner outlined above
we will avoid having to appear before the Council requesting additional
appropriations as we had to do last year. T hope that the Council will
agree with the above course of action.
