GAMMON Approved and signed by me ; 0Z � /Z/ zg 7a Clerk STATE ROAD #23 South Bend Avenue Vaness Street AMENDED ORDINANCE NO. 5452 -72 AN ORDINANCE AMENDING THE MUNICIPAL CODE OF THE CITY OF SOUTH BEND, INDIANA -1962 SECTION 40 AS AMENDED AND GENERAL ORDIN- ANCE NO. 4990 -68, AND THE ACCOMPANYING MAP THERETO, GENERALLY KNOWN AS THE SOUTH BEND ZONING ORDINANCE BY CHANGING THE CLASSIFICATION OF THE USE DISTRICT FOR A CERTAIN PARCEL OF LAND. BE IT ORDAINED BY THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA: Section 1: The municipal Code of the City of South Bend, Indiana, 1962, and General Ordinance No. 4990 -68 and the accompany- ing map thereto, as amended, are further amended insofar as the same relates to that certain parcel of land situate in the City of South Bend, and known and designated as: Part of the Southwest Quarter of the Southeast Quarter of Section 31, Township 38 North, Range 3 East, St. Joseph County, more particularly des- cribed as follows: Beginning at a point on the Westerly line of Indi- ana State Road No. 23 (Edwardsburg Highway) 496.21 feet Southwesterly of (as measured along said West- erly line of said Highway) the North line of the Southwest Quarter of the Southeast Quarter of Sec- tion 31; thence South 34 degrees 32 minutes 40 sec- onds West along said Westerly line of said highway a distance of 155.17 feet to a point; thence North 55 degrees 27 minutes 20 seconds WEst a distance of 300.0 feet to a point; thence north 34 degrees 32 minutes 40 seconds East a distance of 155.17 feet to a point; thence South 55 degrees 27 minutes 20 seconds East a distance of 300.0 feet to the point of beginning, by changing the classification of the "Use District" from C -1 Commercial and "A" Height and Area District to C Com- mercial and "A" Height and Area District, and in conformance with the approved site plan on file in the office of the Area Plan Commission. Section 2: This ordinance shall be in full force and effect from and after its passage by the Common Council, approved by the Mayor and legal publication.
