GAMMON Clerk SOUTH BEND INDIANA ORDINANCE NO. 5429 -72 AN ORDINANCE AMENDING ORDINANCE NO. 4990 -68, AS AMENDED, COMMONLY KNOWN AS "THE ZONING ORDINANCE OF THE CITY OF SOUTH BEND, INDIANA" CHAPTER 40, MUNICIPAL CODE OF THE CITY OF SOUTH BEND, INDIANA. BE IT ORDAINED BY THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA THAT: 1. Ordinance 499068, as amended which said ordinance commonly is known as "The Zoning Ordinance of the City of South Bend, Indiana," be and the same hereby is amended further in order that the zoning classification of the following described real estate in the City of South Bend, St. Joseph County, State of Indiana, to -wit: A tract or parcel of land in the SouthWest Quarter of the Southwest Quarter of Section No. 24, Township 37 North, Range 2 East, bounded by a line running as follows: viz: Beginning at a point Forty (40) feet North and Two Hundred Thirty -eight (238) feet East of the Southwest corner of said Section 24; running thence North 100 feet; thence East 100 feet; thence South 100 feet; thence West 100 feet to the place of beginning, be and the same hereby is established as a "C Commercial District" and "F Height and Area District." 2. This ordinance shall be in full force and effect from and after its passage by the Common Council of the City of South Bend, Indiana, approval by the Mayor of said City, and legal publication. Gentlemen: Mhe attached rezoning petition of David and Frances Frey was legally advertised August 5, and August 12, 1972. The Area Plan Commission gave it public hearing August 15, 1972 at which time the following action was taken: "Upon a motion made by William Richardson, seconded by Elmer Mitchell and unanimously carried the petition of David and Frances Frey to zone from "E" Heavy Industrial to "C" Commercial is returned to the Common Council with a favorable recommendation by the Area Plan Commission." The deliberations of the Area Plan Commission and points considered in arriving at the above decision are shown in excerpts of the minutes and will be forwarded to you at a later date to be made a part of this report.
