ORDINANCE NO. 5428 -72
AN ORDINANCE AMENDING AND SUPPLEMENTING
ORDINANCE NO. 4990 -68 CHAPTER 40 OF THE MUNICIPAL CODE OF
THE CITY OF SOUTH BEND, INDIANA, FORMERLY REFERRED TO
AS ZONING ORDINANCE NO. 3703 AS AMENDED
BE IT ORDAINED BY THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA:
Section 1.
That Zoning ordinance No. 4990 -68, Chapter 40 of the Municipal
Code of the City of South Bend, Indiana, formerly known as Zoning Ord-
inance No. 3702, be and the same is hereby amended and supplemented by
zoning the following described property "B" Residential District and
"G" Height and Area District; a legal description of the property is
as follows:

Beginning at a point of intersection of the center line
of the St. Joseph River with the North right of way
line of Wayne Street extended East; thence West along
the North right of way line of Wayne Street extended
East to the intersection of the East right of way line
of the Jefferson - Western Connector Street; thence
Southerly along the East right of way line of the Jef-
ferson- Western Connector Street to the intersection
with the Westerly line of the New Columbia Street;
thence Southeasterly along the Westerly right of way
line of the New Columbia Street to the intersection
with the South right of way line of Monroe Street;
thence East along the South Right of way line of
Monroe Street to the West right of way line of Fellows
Street; thence South along the West right of way line
of Fellows Street to the South right of way line of
Monroe Street; thence East along the South right of
way line of Monroe Street extended to the intersection
of the South right of way line of Monroe Street and
the center line of Lincolnway East; thence Northeast
along the South right of way line of Monroe Street
extended East to the center of the St. Joseph River;
thence proceeding in a Northwesterly direction along
the center of the St. Joseph River to the intersection
of the North right of way line of Wayne Street extended
East which is the point of beginning.
Section 2.
This Ordinance shall be in full force and effect from and
after its enactment, approval by the Mayor and legal publication.

In Re: A proposed ordinance amending ordinance No.
4990 -68 to zone the Central Downtown Business .
District in accordance with the Downtown Urban
Renewal Project
Gentlemen:
The attached rezoning petition of the Department
of Redevelopment was legally advertised August 5, and
August 12, 1972. The Area Plan Commission gave it public
hearing August 15, 1972 at which time the following action
was taken:
"Upon a motion by William Richardson being
seconded by Joseph Simeri and unanimously
carried, the matter of the zoning for the
Central Business District is returned to the
Con-non Council with a favorable recommendation
as the Area Plan Commission finds it to be
consisten with the Land Use and Transportation
Plan and the Downtown Urban Renewal Program."
The deliberations of the Area Plan Commission and
matters considered in arriving at the above decision are
shown in excerpts of the minutes and will be forwarded to
you at a later date to be made a part of this report.
