AN ORDINANCE AMENDING ORDINANCE NO. 4990 -68, AS AMENDED
COMMONLY KNOWN AS THE ZONING ORDINANCE OF THE CITY OF SOUTH BEND,
INDIANA (Chapter 40, Municipal Code).
BE IT ORDAINED BY THE COMMON COUNCIL OF THE CITY OF SOUTH
BEND, INDIANA:
Section 1:
Ordinance No. 4990 -68, as amended, which ordinance is
commonly known as the Zoning Ordinance of the City of South Bend,
Indiana, be and the same hereby is amended in order that the zoning
classification of the following described real estate in the City of
South Bend, St. Joseph County, State of Indiana:
A parcel of land in the Northwest Quarter of
the Northeast Quarter of Section 4, Township
37 North, Range 3 East in the City of South Bend,
Indiana, described as beginning at a point 91.5
feet West and South 0 004' West, 120 feet from
the Northeast corner of said Quarter Quarter
Section; thence South 0 104' West, 180.88 feet;
thence North 67 026' West, 106.95 feet; thence
North 0 000' West 140.95 feet; thence South 890
17157" East, 98.86 feet to the place of beginning.
be and the same is hereby established as a "C" Commercial District
and a "C" Height and Area District.
Section 2:
This ordinance shall be in full force and effect from and
after its passage by the Common Council, approval by the Mayor, and
legal publication.

I (We), the undersigned, do hereby respectfully make app-
lication and petition the Common_ Council_ of the City of South Bend

as hereinafter requested, and in support of this application,
the following facts are shown
1. The property sought to be rezoned is located =t on the
North side-of Lincoln Way West in the City of South Bend
between Wellington and Kenmore Streets (if said Streets
were extended South to Lincoln Way West) at a point 1100
feet, more or less, East of Sheridan Avenue.

In Re: A proposed ordinance and site development plan of
Associates Bancorp, Inc. to zone from "A" Resi-
dential, "A" Height and Area to "C" Commercial,
property on Lincolnway West.
Gentlemen:
The attached rezoning petition of Associates Ban-
corp, Inc. was legally advertised August 5, 1972 and
August 12, 1972. The Area Plan Commission gave it public
hearing August 15 1972 at which time the following action
was taken:
"Upon a motion made by Ted Sharp, seconded by
Roger Parent and unanimously carried, the peti-
tion of Associates Bancorp, Inc. to zone from
"A" Residential to "C" Commercial is returned to
the Common Council with a favorable recommenda-
tion by the Area Plan Commission."
The deliberations of the Area Plan Commission and
points considered in arriving at the above decision are
shown in excerpts of the minutes and will be forwarded to
you at a later date to be made a part of this report.
