ORDINANCE NO. 5423 -72
AN ORDINANCE AMENDING CHAPTER 40, SECTION
40 -14, OF THE MUNICIPAL CODE OF THE CITY
OF SOUTH BEND, INDIANA, OF 1963, ALSO
KNOWN AS ORDINANCE NUMBER 3702 AS AMENDED,
THE ZONING ORDINANCE OF THE CITY OF
SOUTH BEND, INDIANA.
BE IT ORDAINED BY THE COMMON COUNCIL OF THE CITY OF SOUTH BEND,
INDIANA:
Section 1. That Chapter 40, Section 40 -14 of the Municipal
Code of the City of South Bend, Indiana, adopted by the Common
Council of the City of South Bend, Indiana, on the 14th day of
October, 1963, and more commonly known as the Zoning Ordinance of
the City of South Bend, be amended by the reclassification and
rezoning of a certain parcel of land measuring 47 feet North and
South by 123 feet East and West at the Northwest corner of the
intersection of Ironwood Drive and Fox Street in the City of South
Bend, St. Joseph County, Indiana, more particularly described as
follows:
Lot Numbered 87 as shown on the recorded
Plat of Ewing Park Addition to the City
of South Bend, Indiana,
from "A" Residential District and "A" Height and Area District and
"B" Residential District and "A" Height and Area District.
Section 2. This ordinance shall be in full force and
effect from and after its passage and signing by the Mayor of
the City of South Bend, Indiana.

In Re: Petition to rezone property at Ironwood and Fox
Gentlemen:
The request for rezoning was heard at the Area Plan
Commission Public Hearing of July 18, 1972. At that meeting
this request was recommended unfavorably to the Common Council
of the City of South Bend for the following reasons:
HB:ld
1. The property in question is too small for such
development. The setback required from Iron-
wood would eliminate one parking space in the
rear and when Ironwood is enlarged the new
right -of -way would place the building 10 feet
away.
2. The characteristic of the neighborhood is resi-
dential. To encroach upon this residential
character with a non - residential use would be
detrimental to the area.
