GAMMON ORDINANCE NO. 5& 97- 74/ AN ORDINANCE TO APPROPRIATE $16,300 FROM THE CUMULATIVE CAPITAL IMPROVEMENT FUND, LINE ITEM 260.0, AND $146,700 FROM THE LOCAL ROAD AND STREET FUND TO PROJECT R & S 61, MICHIGAN STREET -MAIN STREET CONNECTOR, WITHIN THE LOCAL ROADS AND STREETS FUND. WHEREAS, there was enacted during the 1969 Session of the Indiana General Assembly an Act, Chapter 392 of the Acts of 1969, making avail- able to cities, towns and counties for engineering, construction or reconstruction of roads, streets and bridges under local jurisdiction, certain additional funds to be derived from the 7th and 8th cents of Indiana motor fuel tax and fuel use tax and from increases in fees levied under the Motor Vehicle Act, and WHEREAS, no appropriation of such funds was included in the regular 1974 budget for the Civil City of South Bend, Indiana; and WHEREAS, an emergency exists requiring the appropriation and expenditure of certain of said funds already received or to be received before the end of the year; and WHEREAS, funds are to be appropriated for the City's matching share from the Cumulative Capital Improvement Fund. NOW, THEREFORE, BE IT ORDAINED by the Common Council of the City of South Bend, Indiana: SECTION I. The following sums of money are hereby appropriated and ordered set apart out of the Local Road and Street Fund and the Cumulative Capital Improvement Fund for the purpose of right -of -way purchase on the following project: PROJECT NO. LOCATION AMOUNT R & S 61 Michigan Street -Main Street Connector Local Road and Street Fund $146,700.00 Cumulative Capital Improvement Fund 16,300.00 TOTAL PROJECT $163,000.00 SECTION II: This Ordinance shall be in full force and effect from and after its passage and approval as required by law. Director, Public Works Members of the Common Council 441 County /City Building South Bend, IN 46601 Gentlemen: Reply To: Department of Public Works June 18, 1974 On June 24 an ordinance appropriating the sum of $16,300 from the Cumulative Capital Improvement Fund, and the sum of $146,700 from the Local Roads and Streets Fund, will be presented for your consideration. These monies will be appropriated to project R & S 61, Michigan Street -Main Street Connector. This money is being appropriated specifically for the purchase of right -of- way needed for this project (Turner Property). To refresh your memory, last year you appropriated $20,000 to accomplish the design phase of this project. We are presently at a point where there must be a decision made on the right -of -way in order to complete the final design and get the project ready for construction phase. In giving you affirmative consideration to this request, I feel that we will not be placed in the same situation as was the case with Michigan, Main and Chippewa.
