ORDINANCE NO. 5611 -73
AN ORDINANCE AMENDING THE MUNICIPAL CODE
OF THE CITY OF SOUTH BEND, INDIANA, FOR
THE REGULATION OF CITY -OWNED VEHICLES.
WHEREAS, the Common Council is concerned about
the number and use of motor vehicles by the City of South
Bend; and
WHEREAS, the Common Council desires to provide
for a more efficient means of regulating the number and use
of city vehicles,
NOW, THEREFORE, BE IT ORDAINED by the Common
Council of the City of South Bend, Indiana, as follows:
SECTION I. The Municipal Code of the City of
South Bend, Indiana, is hereby amended by the addition thereto
of the following new Section 2 -47A:
Sec. 2 -47A Regulation of city -owned vehicles.
(a) It shall be the duty of the City Controller
(Director of the Department of Administration and Finance) to
annually prepare and file with the City Clerk a motor vehicle
report setting forth the following information:
1. Name of department, sub - department,
bureau or office to which vehicle
is assigned;
2. Name and title of person using
vehicle or to whom vehicle is
assigned;
3. Make and year of vehicle;
4. Description of vehicle;
5. Mileage of vehicles as of January 1
of year of report;
6. License number of vehicle;
7. City number of all vehicles;
8. Explanation of the use and need for
all city vehicles.
Said report shall be filed with the City Clerk on
or before the first day of April of each year.
(b) In preparing the various budgets which are
submitted for Council approval, the Controller shall include
all vehicles to be purchased in the line item "Motor Vehicles"
and shall place them in the budget of the particular department
or bureau which will be using the vehicle.
(c) All city -owned vehicles shall have the name
of the city department or bureau and an identifying number,
of not less than five inches in height, inscribed on the
front doors and rear of said vehicles. Said number shall be
included in the report under paragraph (a) 7 of this section.
Every city -owned vehicle shall have its own number which shall
not be used by any other city -owned vehicle at the same time.
Any other markings may be made which are deemed appropriate by
the proper city department.
(d) The first sentence of paragraph (c) of this
section shall not apply to the Mayor's vehicle and to police
vehicles deemed to be used as unmarked vehicles and designated
as such by the Chief of Police.
SECTION II. This Ordinance shall be in full force
and effect roam and after its passage by the Common Council
and its approval by the Mayor.

The Council Committee on Motor Vehicles makes
the following recommendations regarding the administra-
tion of city -owned vehicles, to -wit:
1. That the city purchase medium and
small -size passenger cars to reduce
initial cost, operating expenses,
repair time, and to conserve funds.
2. That city -owned vehicles shall not
be equipped with air conditioning
unless funds are specifically approved
by the Council.
3. That the number of city -owned vehicles
be reduced. This should be based on
miles driven for city business only.
4. That the vehicle identification number
be used on all records pertaining to
the purchase, operation and maintenance
of each particular vehicle.
5. That a policy be established by the
administration setting forth when a
vehicle may be taken home overnight
to a city employee's residence and
under what conditions a city employee
may receive a car allowance and /or
mileage allowance in lieu of a city
vehicle.
The committee also recommends passage of an
ordinance regulating city -owned vehicles. The
committee intends to file the ordinance prior to
the next regular Council meeting.
