GAMMON ORDINANCE NO. 5609 -73 AN ORDINANCE AMENDING AND SUPPLEMENTING CHAPTER 40 OF THE MUNICIPAL CODE OF SOUTH BEND, INDIANA (SOUTHWEST CORNER OF IRONWOOD DRIVE AND RIDGEDALE ROAD). BE IT ENACTED BY THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA, THAT: Section 1. Chapter 40 of the Municipal Code of South Bend, Indiana (South Bend City Zoning Ordinance No. 3702) be, and the same is hereby amended, supplemented and changed in Section 40 -14 (Section 2 of Ordinance No. 3702) thereof to pro- vide that the following described real estate located in the City of South Bend, Indiana, to -wit: Lots 572 and 652 of Twyckenham Hills Addition, Section "K" as shown on the recorded plat thereof in the Office of the Recorder of St. Joseph County, Indiana, be and the same hereby is changed in its Use District regulation classification from "B" Residence District, to "B" Residence District, subject to, and in accordance with the modified site development plan as submitted with the petition to amend filed by Ridgedale Nursing Home, provided that the landscaping shown on the South and West sides of the site be, or be made, of sufficient density to prevent normal passage of persons through such land- scaping; and that landscaping of sufficient density to obscure vision from the North be established along the Northerly and Westerly boundaries in the area where loading and unloading is performed, all such landscape screening to be installed within one month from the effective date of this ordinance. The petitioner shall certify in writing to the President of the Common Council at the end of the month that the plantings have been installed in accordance with the ordinance requirements. Section 2. This ordinance is to be in full force and effect from and after its enactment, the approval of the Mayor, and its publication according to law. Section 3. Kelly was legally advertised October 6, and October 13, 1973. The Area Plan Commission gave it public hearing October 16, 1973 at which time the matter was tabled. The petition again came on to be heard at a special meeting of the Area Plan Commission November 6, 1973 at which the following action was taken: Upon a motion by Russell Rothermel being seconded by Ted Sharp and carried, with John Peddycord and Roger Parent abstaining, the petition of James R. Kelly (Ridgedale Nursing Home) to revise a previously ap- proved site plan, property located at the southwest corner of Ironwood Drive and Ridge- dale Road, City of South Bend, is favorably recommended to the Common Council by the Area Plan Commission."
