S & o 8 -'7 3 An Ordinance establishing a new schedule of rates and charges for services rendered by the waterworks system of the City of South Bend and repealing Ordinance No. 4320 -60 and Ordinance No. 4345 -60 WHEREAS, the Common Council of the City of South Bend has heretofore on May 23, 1960, adopted Ordinance No. 4320- 60 establishing a schedule of rates and charges for services rendered by the waterworks system of the City of South Bend, which ordinance was amended by Ordinance No. 4345 -60, adopted on November 2, 1960; and WHEREAS, due to the passage of time and resultant in- creases in the financial requirements of the waterworks, the Council now finds that the revenues provided by the rates and charges established by said ordinances are insufficient to meet the financial requirements of the waterworks; and WHEREAS, the Council now finds that in order to meet such financial requirements, it is necessary that the rates and charges be increased for the services rendered by said waterworks; now therefore, BE IT ORDAINED BY THE COMMON COUNCIL OF THE CITY OF SOUTH BEND: Section 1. There shall be and are hereby established for the use of and the services rendered by the waterworks system of the City of South Bend, the following rates and charges, based upon the use of water and facilities furnished by said waterworks system: (a) Consumption Per Monthly Rate Per Billing Period 100 Cubic Feet First 500 cubic feet $ 0.33 Next 1,500 cubic feet .30 Next 2,500 cubic feet .27 Next 7,500 cubic feet .23 Next 18,000 cubic feet .20 Next 20,000 cubic feet .18 Next 50,000 cubic feet .15 over 100,000 cubic feet .12 (b) Consumption Per Bi- Monthly Rate Per Billing Period 100 Cubic Feet First 1,000 cubic feet $ 0.33 Next 3,000 cubic feet .30 Next 5,000 cubic feet .27 . In such cases as the utility may deem it impracticable to install a meter for temporary service, there shall be a minimum charge of $7.50. If the wa- ter consumption computed at approved rates is known to be in excess of the $7.50 minimum charge, an authorized agent of the utility shall have the right to estimate said water consumption and the estimated consumption shall be billed at the ap- proved meter rates. (g) Collection or Deferred Payment Charge All bills for water services not paid within fif- teen (15) days from the due date thereof, as stated in such bills, shall be subject to a col- lection or deferred payment charge of 10% on the first $3.00 and 3% on the excess over $3.00. Sec. 2. This ordinance shall be in full force and effect from and after its passage and Ordinance No. 4320 -60 and ordi- nance No. 4345 -60 are hereby repealed; provided, however, that said ordinances shall not be deemed repealed and the schedule of rates and charges herein set out shall not become effective unless and until the schedule of rates and charges herein set out shall have been approved by the Public Service Commission of Indiana or until such time as said Commission shall direct; and until such approval by the Public Service Commission of Indiana, Ordinance No. 4320 -60 and Ordinance No. 4345 -60 shall remain in full force and effect and the rates established by such ordinances shall continue in effect.
