ORDINANCE NO. 5597 -73
AN ORDINANCE AMENDING AND SUPPLEMENTING
ORDINANCE NO. 4990 -68, CHAPTER 40 OF THE
MUNICIPAL CODE OF THE CITY OF SOUTH BEND,
INDIANA, FORMERLY REFERRED TO AS ZONING
ORDINANCE NO. 3702, AS AMENDED (2017
WEST DUBAIL STREET).
BE IT ORDAINED BY THE COMMON COUNCIL OF THE CITY
OF SOUTH BEND, INDIANA:
Section 1. That Zoning Ordinance No. 4990 -68,
Chapter 40 of the Municipal Code of the City of South Bend,
Indiana, formerly known as Zoning Ordinance No. 3702, be and
the same is hereby amended and supplemented by zoning the
following described property "C -1" Commercial District and "A"
Height and Area District. A legal description of the property
is as follows:
Lot #92, as shown on plat of Highland Park,
an addition to the City of South Bend.
Recorded in Plat Book 8 - Page 82. Bound
on the west by S. Warren Street, bound on
the south by W. Dubail Street, east to alley,
bound on the north, forty feet to Lot #93,
owned by Arthur Tschida, 1636 W. Warren
Street, South Bend, Indiana.
Section 2. This Ordinance shall be in full force
and effect from and after its enactment, approval by the Mayor
and legal publication.

Respectfully report that they have examined the matter and that in their opinion the Ordinance should go
to the Council as favorable, as amended below:
That the request for zoning to "C" Commercial be amended to
read "C -1" Commercial.

The Area Plan Commission reiterated, at its meeting
of February 19, 1974, its original unfavorable recommendation
of the above rezoning proposal due to the following:
1. The zoning does not meet any formal comprehensive
plan or, for that matter, any plan for land use in
that area.
2. This small parcel is being singled out and the pro-
posed use classification is totally different from that
of the surrounding area.
3. The proposed use is for the benefit of the owner of
said property and would be detrimental to owners of the
surrounding property in that it will generate excessive
traffic, disruptthe residential character of the neigh-
borhood and could encourage haphazard development as
well as other commercial uses in the neighborhood.
4. This zoning proposal is in direct opposition to
zoning purposes and the spirit and intent of zoning
laws and acts.
5. This zoning proposal grants such property privileges
which are not granted or extended to other land in the
vicinity.
The Area Plan Commission did, however, approve the final
site plan for the subject site at its meeting March 19, 1974.
