GAMMON Approved and signed by Clerk ORDINANCE NO. 5593 -73 AN ORDINANCE AMENDING CHAPTER 13 OF THE MUNICIPAL CODE OF THE CITY OF SOUTH BEND, INDIANA, 1971, BY THE ADDITION OF ARTICLE 6 TO PROHIBIT THE BURNING OF LEAVES WITHIN THE CITY. NOW, THEREFORE, BE IT ORDAINED by the Common Council of the City of South Bend: SECTION 1. Chapter 13 of the Municipal Code of South Bend, Indiana, 1971, is hereby amended by the addition thereto of the following new article: Article 6 AIR POLLUTION CONTROL Sec. 13 -76 Leaf burning forbidden. (a) No person shall initiate, cause, or allow any form of leaf burning on public or private property during any time within the City of South Bend, except that leaf burning will be allowed from 7:00 a.m. to 7:00 p.m., at the following times during the year: From October 15 to November 15 and from April 15 to May 15 of each year. Sec. 13 -77 Penalty. Any person violating any provision of Article 6, Section 13 -76, shall, upon conviction, be deemed guilty of a mis- demeanor and shall be punishable by a fine of not less than Ten Dollars ($10.00) but no more than One Hundred Dollars ($100.00). SECTION 2. This Ordinance shall be in full force and effect from and after its passage by the Common Council, its approval by the Mayor and publication as required by law. Respectfully report that they have examined the matter and that in their opinion the Ordinance should go to the Council as favorable, as amended: Add the following to Sec. 13 -76 (a): "except that leaf burning will be allowed from 7:00 a.m. to 7:00 p.m., at the following times during the year: From October 15 to November 15 and from April 15 to May 15 of each year." Sec. 13 -77 to read as follows: Any person violating any provision of Article 6, Section 13 -76, shall, upon conviction, be deemed guilty of a misdemeanor and shall be punishable by a fine of not less than Ten Dollars ($10.00) but no more than One Hundred Dollars ($100.00)."
