ORDINANCE NO. 5592 -73
AN ORDINANCE REQUIRING CERTAIN CITY DEPARTMENTS
TO SUBMIT BUDGETS TO COMMON COUNCIL.
WHEREAS, certain bureaus of the Department of Public
Works presently are not required to submit budgets to the Common
Council for its approval; and
WHEREAS, the Common Council desires that said bureaus
shall annually submit budgets to the Council for its approval,
NOW, THEREFORE, BE IT ORDAINED by the Common Council
of the City of South Bend as follows:
SECTION 1. It shall be the duty of the City Controller
(Director o the e Department of Administration and Finance) to
annually prepare budgets for the next succeeding calendar year for
the following bureaus of the Department of Public Works:
1. Bureau of Municipal Parking
2. Bureau of Sewers
3. Bureau of Solid Waste
4. Bureau of Water Supply
5. Bureau of Wastewater
SECTION 2. Said budgets shall be presented to the Mayor
for his recommendations. The budgets shall then be presented to the
Common Council in ordinance form, making appropriations by items
for the use of said bureaus and estimates of the revenue to be
received by said bureaus, if any, and a statement of the revenues
received in the last complete calendar year, if any.
SECTION 3. The budgets shall be on a calendar -year
basis and shall be submitted to the Common Council on or before
November 1 of the preceding year. The Council shall act promptly
on said budgets and shall pass the budgets on or before the last
day of November of the preceding year.
In the event the Council does not act on or before the
last day of November, then the budgets previously passed by the
�- Council shall remain in effect.
The Council shall have the power to reduce said budgets
but may not increase them unless recommended by the Mayor.
SECTION 4. Any person violating this ordinance shall
be guilty 01 a misdemeanor and shall be subject to imprisonment
in the County Jail for a period not in excess of six (6) months,
or be subject to a fine not in excess of Five Hundred and 00 /100
..� Dollars ($500.00), or both, and said person may be subject to
removal from office.
SECTION 5. This ordinance shall be in full force and
effect from and after its passage by the Common Council, approval
by the Mayor and legal publication.
In the event this ordinance does not take effect on or
before November 1, 1973, then the budgets to be submitted in 1973,
for calendar year 1974 only, shall be submitted to the Council on
or before December 1, 1973, and the Council shall pass said budgets
on or before December 31, 1973.

to the Council as favorable, as amended: .
Insert the word "certain" in the title of the ordinance
immediately after the word "requiring ".
In Section 2, add the following as a continuation of the
last line:
"and a statement of the revenues received in the
last complete calendar year, if any."
