AN ORDINANCE AMENDING THE MUNICIPAL CODE
OF THE CITY OF SOUTH BEND, INDIANA -1962
SECTION 40 AS AMENDED AND GENERAL ORDINANCE
NO. 4990 -68, AND THE ACCOMPANYING MAY THERETO
GENERALLY KNOWN AS THE SOUTH BEND ZONING
ORDINANCE BY CHANGING THE CLASSIFICATION OF
THE USE DISTRICT FOR A CERTAIN PARCEL OF LAND.
BE IT ORDAINED BY THE COMMON COUNCIL OF THE CITY OF SOUTH BEND,
INDIANA:
Section 1:
The municipal Code of the City of South Bend, Indiana,
1962, and General Ordianance No. 4990 -68 and the accompaning
map thereto, as amended, are further amended insofar as the
same relates to that certain parcel of land situate in the City
of South Bend, and known and designated as:
Lots Numbered Two Hundred Fifty (250) and Two Hundred
Fifty One (251) as shown on the revised plat of Broad -
moor Third (3rd) Section, an addition to the City of
South Bend, County of St. Joseph, State of Indiana,
by changing the classification of the "Use District" from
"B" Residential use and "B" height and area district to "C"
Commercial use and "C" height and area district, and in
conformance with the approved site plan on file in the office
of the Area Plan Commission.
Section 2:
This ordinance shall be in full force and effect from
and after its passage by the Common Council, approved by the
Mayor and legal publication.

southeast end of the Broadmoor Shopping Center on
Miami and Ireland Road, City of South Bend, A
Height and Area
Gentlemen:
The attached rezoning petition of Broadmoor Shopping
Center, Inc. was legally advertised September 8, 1973 and
September 15, 1973. The Area Plan Commission gave it a
public hearing September 18, 1973, at which time the following
action was taken:

"A motion by Ted Sharp to amend the petition of
Broadmoor Shopping Center, Inc. to be a request
for "C" Commercial instead of "B" Residential, and
to change the height and area request from "C" to

to favorably recommend the petition, as amended, of

I (We), the undersigned, do hereby respectfully make
application and petition the COMMON COUNCIL OF SOUTH BEND,
INDIANA to amend the Zoning Ordinance of
South Bend, Indiana as hereinafter requested, or in the
alternative for the Executive Board of the Area Plan Commission to
approve: the site plan that is being filed herewith because
the two lots sought to be rezoned have already been rezoned
by the Common Council on November 22, 1971, and in support of
this application, the following facts are shown:
1. The property sought to be rezoned is located at the
extreme Southeast end of the Broadmoor Shooping Center
located on Miami Street and Ireland Road in the City of
South Bend, County of St. Joseph, State of Indiana.
2. The property is owned by
Broadmoor Shopping Center, Inc.
3. A legal description of the property is as follows:
Lots Numbered Two Hundred Fifty (250) and Two Hundred Fifty
One (251) as shown on the revised plat of Broadmoor Third
(3rd) Section, an addition to the City of South Bend,
County of St. Joseph, State of Indiana.
4. It is desired and requested that the foregoing property
be rezoned:
From B Residential Use and B Height and Area District.
To C Commercial Use and C Height and Area District
5. It is proposed that the property will be put to the follow-
ing use and the following buildings) will be constructed
(including number of dwelling units if residential)
A branch drive in for the National Bank and Trust Company
of South Bend, Indiana where people may bank from their
car or enter the premises to conduct their business.
6. Number of off street parking spaces to be provided
60 off street parking spaces
7. Attached is a copy of: a.) an existing plot plan showing
the property and other surrounding properties; b.) names and
addresses of all the individuals, firms or corporations owning
