ORDINANCE NO. 5-59'1 - '23
AN ORDINANCE TRANSFERRING THE SUM OF $6,000.00 FROM
ACCOUNT NO. 630.0 "PERF" TO ACCOUNT 530.0 "REFUNDS,
AWARDS, AND INDEMNITIES "ALL ACCOUNTS BEING WITHIN THE
CONTROLLERS BUDGE%, CITY OF SOUTH BEND, INDIANA.
WHEREAS, certain extraordinary conditions have developed since
the adoption of the existing annual budget for the Controller's Department, so
that it is now necessary to appropriate more money than was appropriated in the
annual budget for the various functions of City Government to meet such
extraordinary conditions; and
WHEREAS, additional funds are needed by the Controllers Department
in Account 530 "Refunds, Awards, and Indemnities "; to assure that Departments
ability to perform its functions; and
WHEREAS, a surplus exists in other accounts where it is not
presently needed and more specifically as follows, To -Wit:
$6,000.00 in Account 630.0 "PERF"
NOW, THEREFORE, BE IT ORDAINED by the Common Coiincil of the
City of South Bend, Indiana:
SECTION I. That the sum of $6,000.00 from Account 630.0,
"PERF ", be transferred to the following account:
A. Account No. 530.0
$6,000.00
All above accounts are within the Controllers budget and all within the
General Fund of the City of South Bend, Indiana.
SECTION II. This ordinance shall be in full force and effect
from and after its passage by the Mayor, and the fulfillment of all Statutory
requirements for emergency appropriations.

SUBJECT: TRANSFER OF FUNDS FROM "P,E.R.F." TO REFUNDS, AWARDS, AND
INDEMNITIES
The budget estimate in 1973 for claims the City would be required to pay
in Refunds, Awards, and Indemnities, was set at $45,000.00. This was cut
by the Common Council to $20,000.00, and we find at this time, that this
will not be sufficient to protect the City from potential law suits for
the balance of the year.
The two claims which have been attached to the Ordinance, totaling $1,500.00,
were recommended for payment by the City Attorney on the basis that the
City would lose in both instances if they are taken to court.
In addition, there is a $600.00 claim pending, which has been in litigation
since 1969, on a personal injury claim, which the City has lost. Also,
the personal injury department claims for the Police Dept., Street Dept.,
Fire Dept., etc., have been averaging about $1,000.00 per month.
We presently have only $400.00 left in Refunds, Awards, and Indemnities
account.

Release and Indemnification of Claims
To: Board of Public Safety
City of South Bend, Indiana
For valuable consideration, I hereby release and discharge the City
of South Bend, the South Bend Police Department, all agents, employees
and officers of the City of South Bend, from all actions and omissions,
causes of action, damages, including acts of negligence and wilful and
wanton misconduct, claims and demands in law or in equity of every kind
and character I may have, or my successors, assigns, heirs, executors or
administrators may hereafter have against them, or any of them, and
hereby waive all claims against them or any of them,
resulting from my arrest and incarceration on March 7, 1973 by Cpl.
Stephen W. Hedl of the South Bend Police Department.
I also agree to indemnify and forever hold the City of South Bend, the
South Bend Police Department, all agents, employees and officers of the
City of South Bend harmless against and from any cause of action in law
or in equity which hereafter may be instituted or recovered against the
City of South Bend or South Bend Police Department by myself or by any
other person whomsoever for the purpose of enforcing a claim for damages
on account of personal injury or property damage or conscious suffering
arising out of my arrest and incarceration on March 7, 1973 by Cpl.
Stephen W. Hedl of the South Bend Police Department.
