S S 7 8 -7,3 AN ORDINANCE FOR THE TRANSFER OF FUNDS IN THE AMOUNT OF $16,524.17 FROM THE LOCAL ROAD AND STREET FUND PROJECT R & S 40 - WIDENING OF IRELAND ROAD FROM MICHIGAN STREET TO MIAMI ROAD AND $5,508.05 FROM THE CUMULATIVE CAPITAL IMPROVEMENT FUND TO PROJECT R & S 51 - SAMPLE STREET WIDENING FROM MAYFLOWER ROAD TO GREENVIEW AVENUE. WHEREAS, there was enacted during the 1969 session of the Indiana General Assembly an Act, Chapter 392 of the Acts of 1969, making available to cities, towns and counties for engineer- ing, construction or reconstruction of roads, streets and bridges under local jurisdiction, certain additional funds to be derived from the 7th and 8th cents of Indiana motor fuel tax and fuel use tax and from increases in fees levied under the Motor Vehicle Act; and WHEREAS, no appropriation of such funds was included in the regular 1973 budget for the Civil City of South Bend, Indiana; and WHEREAS, an emergency exists requiring the appropriation and expenditure of certain of said funds already received or to be received before the end of the year 1973; and WHEREAS, funds have been appropriated for the City's matching funds; and WHEREAS, certain extraordinary conditions have developed so that it is now necessary to appropriate additional funds to Project R & S 51 which was under - funded - Sample Street widening from Mayflower Road to Greenview Avenue, to meet expenses; and WHEREAS, a surplus exists in Account R & S 40, which has been completed - Widening of Ireland Road from Michigan Street to Miami Road and in the Cumulative Capital Improvement Fund. NOW, THEREFORE, BE IT ORDAINED by the Common Council of the City of South Bend, Indiana: SECTION I. The following sums of money are hereby ordered transferred from: Project No. Location Amount R & S 40 Widening of Ireland Road $22,032.22 from Michigan Street to Miami Road TO: R & S 51 Sample Street Widening from Mayflower Road to Greenview Avenue Local Road and Street Fund $16,524.17 Cumulative Capital Improvement Fund 5,508.05 TOTAL TRANSFER $22,032.22 SECTION II. At the time of the original appropriation of $165,000 the project estimate was about $130,000. After reviewing the preliminary plans it was decided that the intersection of Mayflower and Sample should be in- cluded in the project. This included curbing, widening of the inter- ignalization. It was also decided that for ridability and section and s appearance, it would be better to remove existing intersections at cross streets within the project limits. This additional work raised the esti- mate to $197,530.65. Bids were received on Apri at,a bid of 1d$172,845.40. bidder was Rieth -Riley Construction Company, While over the original estimate and appropriation, this bid was well under the consultant's revised estimate. We are asking you to approve this ordinance transferring the balances from R &S 40 Ireland Road, to this project. R &S + e 0 th`LmR'S.A aboard and balance they does exist in the project. We have applied o give all indications of being in favor of this transfer. -z- Since the project is not complete, I cannot give you a final cost at this time, however it will not exceed the total funds avail- able with this transfer. At the completion of R &S 51 the balances will revert to their respective funds. If you have further questions, I will be glad to try and provide answers for you. Respectfully, Rollin E.
