GAMMON Clerk ORDINANCE NO. 5645 -74 AN ORDINANCE ESTABLISHING THE SOUTH BEND CRIME COMMISSION WHEREAS, the Common Council and the Mayor of the City of South Bend are concerned about the crime problem within our city; and WHEREAS, the Common Council and the Mayor seek to promote citizen involvement in the criminal justice system; and WHEREAS, the City of South Bend desires to establish a crime commission to investigate and make recommenda- tions concerning the criminal justice system in our community. NOW, THEREFORE, BE IT ORDAINED by the Common Council of the City of South Bend, Indiana, that: SECTION I. CRIME COMMISSION - CREATION There shall be created a crime commission in the City of South Bend to be known as the "South Bend Crime Commission ". The members of the Commission shall receive no salary for their services, but shall be entitled to receive their necessary expenses in all work in connection with the duties of the work of the Commission. The Commission shall be composed of nine members, four of whom shall be appointed by the Council, four of whom shall be appointed by the Mayor, and one to be a joint appoint- ment by the Mayor and the President of the Council. The members of the Commission shall serve the term of four years, except for their initial terms which shall be for periods of one, two, three and four years. The Council and the Mayor shall assign one of their initial four appointments to a term of one year, another to a term of two years, another to a term of three years, and another to a term of four years. The joint appointee, who shall be the Chairman of the Crime Commission, shall be for a term of four years. SECTION II. CRIME COMMISSION - ORGANIZATION Within ten days after all of the members of the Commission have been appointed as hereinbefore provided, they shall hold a meeting and shall, from their own number, elect a Vice - Chairman who shall serve as Chairman in the absence of the Chairman. The Chairman shall be that member of the Commission who is jointly appointed as hereinbefore provided. SECTION III. CRIME COMMISSION - GENERAL POWERS The Commission shall have full and complete power in all matters pertaining to the study and investigation of the criminal justice system. SECTION IV. CRIME COMMISSION - POWERS AND DUTIES For the purposes of carrying out the purposes and intent of this act, the South Bend Crime Commission shall have the following powers and duties, and such Commission is hereby authorized to do and perform any of the following: 1. To set the date of, and to hold such meetings of the Commission as may be deemed necessary, from time to time, but not less than once a month. 2. To employ an executive director, secretary and such other experienced help or assistance as may be deemed necessary by the Commission. 3. To establish standards and qualifications for the appointment of all personnel, fix their compensation and approve their appointments without regard to political considerations. 4. To adopt such by -laws as the Commission may deem necessary for the regulation of its internal affairs. 5. To prepare and submit an annual report concerning the Commission's activities during the prior calendar year. Said annual report shall be filed with the office of the City Clerk on or before the first day of March of the following year. 6. To subpoena witnesses and to subpoena documents, writings and records pertinent to matters under investigation or in question before the Commission. 7. To investigate and make recommendations as to any and all matters which the Commission shall deem appropriate and necessary for the improvement and effective operation of the criminal justice system in St. Joseph County and the City of South Bend. SECTION V. This Ordinance shall be in full force and effect from and after its passage by the Common Council and approval by the Mayor.
