An Ordinance amending Chapter 4, Article 8, Section
4 -48 (P), of the Municipal Code of the City of South Bend,
Indiana
WHEREAS, the Board of Park Commissioners, of the
City of South Bend, Indiana, has received numerous complaints
about Section 4 -48 (P) which prohibits the use of mineral or
metal detectors and after review of said sections by the Board
of Park Commissioners, the Board is hereby requesting the
ordinance be amended,
NOW, THEREFORE, BE IT ORDAINED by the Common Council
of the City of South Bend, Indiana that
Section I Chapter 4, Article 8, Section 4 -48 (P)
be amended to read "Use of mineral or metal detectors is pro-
hibited except by permit from the Board of Park Commissioners.
Section II This ordinance shall be in full force
and effect from and after its passage by the Common Council
of the City of South Bend, its signing by the President of
the Common Council and its approval by the Mayor of the City
of South Bend, Indiana and its publication as required by law.

Dear Mr. Nemeth:
Since the passing of the Park Rules and Regulation Ordinance,
the Park Board has received numerous complaints about the
section pertaining to the use of metal detectors.
The ordinance was written to prohibit the use of metal
detectors because of the damage that could be done to park
property.
A representative, of a metal detector club, appeared before
the Board and objected to the ordinance. He stated that
qualified users of metal detectors would not harm any park
property but in fact would help police the litter and trash
from park areas. The club official stated metal detecting
is a form.of recreation for many persons in South Bend.
The metal detecting club volunteered their services to teach
persons the:right way to use metal detectors.
After listening to the clubs request, the Park Board is re-
questing the Common Council to amend the present ordinance
to read "the use of mineral or metal detectors is prohibited
except by permit issued by the Board of Park Commissioners ".
