S G 3 8- -) AN ORDINANCE TO AMEND THE ZONING ORDINANCE OF THE CITY OF SOUTH BEND, IDENTIFIED AS ORDINANCE NO. 4990, ORDINANCE NO. 3702, AS AMENDED, TO THE EXTENT IT IS STILL EFFECTIVE, AND THE MUNICIPAL CODE OF SOUTH BEND, INDIANA, SECTIONS 40 -1 TO SECTIONS 40 -43, AS AMENDED, TO THE EXTENT IT IS STILL EFFECTIVE. BE IT ORDAINED by the Common Council of the City of South Bend, Indiana SECTION I. That the following described real estate in the City of South Bend, Indiana, to -wit: Lots Numbered Sixty -eight (68), Sixty -seven (67) and Sixty -six (66) as shown on the recorded Plat of Kaley's Subdivision of the Southeast part of the Southwest quarter (4) of Section three (3) Township Thirty - -seven (37) north, Range two (2) East, now within and a part of the City of South Bend, in St. Joseph County, Indiana, AND A lot or parcel of land sixteen (16) feet in width East and West, taken off of and from the entire length of the West side of Lot Numbered Sixty -five (65), as shown on the recorded Plat of Kaley's Subdivision of the Southeast part of the Southwest quarter (,) of Section three (3) Township Thirty -seven (37) north, Range two (2) East, now within and a part of the City of South Bend, in St. Joseph County, Indiana be and the same is hereby zoned D Light Industrial and D Height and Area District, the same to conform with the site development plan submitted herein. JEFFERSON BLVD., SOUTH BEND, INDIANA 96801 (219) 284 -8571 January 16, 1974 In Re: A proposed ordinance and site development plan of Bert and John Marroni to zone from "B" Residential, "B" Height and Area, to "D" Light Industrial, "D" Height and Area, property located at 2530 Kenwood, City of South Bend Gentlemen: The attached rezoning petition of Bert and John Marroni was legally advertised on January 5, 1974 and January 12, 1974. The Area Plan Commission gave it a public hearing January 15, 1974, at which time the following action was taken: "Upon a motion made by Robert Lehman, seconded by Elmer Mitchell and carried, the petition of Bert and John Marroni to zone from "B" Residential, "B" Height and Area, to "D" Light Industrial, "D" Height and Area, is returned to the Common Council with a favorable recommendation, subject to a final site plan, by the Area Plan Commission." The above recommendation is made subject to a final site plan and the preliminary site plan is attached hereto. The deliberations of the Area Plan Commission and points considered in arriving at the above decision are shown in the minutes of that public hearing and will be forwarded to you at a later date to be made a part of this report.
