AN ORDINANCE AMENDING ORDINANCE NO. 4990 -68, AS AMENDED,
COMMONLY KNOWN AS THE ZONING ORDINANCE OF THE CITY OF SOUTH BEND,
INDIANA (Chapter 40, Municipal Code).
BE IT ORDAINED BY THE COMMON COUNCIL OF THE CITY OF SOUTH
BEND, INDIANA:
Section 1:
Ordinance No. 4990 -68, as amended, which ordinance is
commonly known as the Zoning Ordinance of the City of South Bend,
Indiana, be and the same hereby is amended in order that the zoning
classification of the following described real estate in the City of
South Bend, St. Joseph County, State of Indiana:
A parcel of land in the Southwest One- Quarter
(1/4) of Section 25, Township 37 North, Range 2
East, described as commencing at the Northwest
corner of Lot Numbered 21 in Hawblitzel's Addition,
which point is also on the South line of Ireland
Road; thence West along the South side of Ireland
Road 553.7 feet; thence South 300 feet; thence
East on a line parallel to the South line of said
Ireland Road 553.7 feet, more or less; thence North,
300 feet, more or less, to the place of beginning
in St. Joseph County, Indiana, containing 3.81
acres, more or less.
be and the same is hereby established as 11C -2 Planned Shopping
Center" and a "C" Height and Area District.
Section 2:
This ordinance shall be in full force and effect from and
after its passage by the Common Council, approval by the Mayor, and
legal publication.

Respectfully report that they have examined the matter and that in their opinion the Ordinance should go
to the Council as favorable, as amended below:
Amend the legal description to read:

I (l!e), the undersigned, do hereby respectfully make app-
lication and petition the Cot mnn Council of the City of South Bend
to amend the Zoning Ordinance of Th e City of South Bend
as hereinafter requested, and.in support of this application,
the following facts are shown
1. The property sought to be rezoned is located
on the South side of Ireland Road between a point 177.2
feet East of the East . line of St. Joseph Street running
East 553.7 feet to a point 143 feet West of the West line
of Fellows Street. See Exhibit A attached hereto and made
a part hereof.
2. The property is owned by
various parties, all of which have optioned to sell to
Petitioners -their properties described in Paragraph .3 of
this petition.

J. Frank Hartwig and James P. Locker to zone from
"A" Residential, "A" Height and Area, to "C -2"
Planned Shopping Center, "C" Height and Area,
property located on the south side of Ireland Road
east of St. Joseph Street, west of Fellows Street,
City of South Bend
Gentlemen:
The attached rezoning petition of J. Frank Hartwig and
James P. Locker was legally advertised January 5, 1974 and
January 12, 1974. The Area Plan Commission gave it a public
hearing January 15, 1974, at which time the following action
was taken:
"A motion was made by Roger Parent to unfavorably
recommend the petition of J. Frank Hartwig and
James P. Locker, not in objection to the proposed
commercial development with frontage on Ireland
north of the K -Mart property line, but rather in
objection to the extension of such commercial
development south along what we consider to be the
K "Mart east property line.
Mr. Parent's motion was then seconded by Ted Sharp
and carried with 7 voting "Yes for the motion, 3
voting "No" and Elmer Mitchell and J. Frank Miles
abstaining.
For these reasons the petition of J. Frank Hartwig
and James P. Locker to zone from "A" Residential,
"A" Height and Area to "C -2" Planned Shopping Center,
"C" Height and Area, is unfavorably recommended to
the Common Council by the Area Plan Commission."

points considered in arriving at the above decision are shown
in the minutes of that public hearing and will be forwarded
to you at a later date to be made a part of this report.
