The Police Department has had a full time attorney during the past year who has provided advice and assistance to them in matters of criminal and civil law. This attorney will not be there in 1974. I would like to hire a part time deputy to continue this work. He would work under my supervision. I would intend that he meet on a weekly basis with groups of officers to advise them in the areas of arrests, search and seizure, interrogation, evidence, etc. All of these areas are concerned with criminal law but civil law is also involved. If an arrest is improper or if excessive force is used, the City of South Bend can be liable. A good attorney can save the City a serious lawsuit by timely advice to the police. He also could assist in the effort to reduce crime by telling the police what they can do in order to make a good arrest which will result in a conviction. For these reasons, I recommend that this attorney be hired. Ca es A.
