AN ORDINANCE APPROPRIATING $5,991.27 FROM THE
FEDERAL ASSISTANCE GRANT COMMONLY REFERRED TO
AS GENERAL REVENUE SHARING, FOR VARIOUS LAW
ENFORCEMENT PROGRAMS, TO BE ADMINISTERED BY
THE CITY OF SOUTH BEND THROUGH ITS DEPARTMENT
OF LAW.
WHEREAS, additional funds are needed by the Department of
Law to administer certain law enforcement programs and to insure the Department's
ability to properly perform its functions during the year of 1974.
NOW, THEREFORE, BE IT ORDAINED by the Common Council of the
City of South Bend as follows:
SECTION I. That the sum of $5,991.27 is hereby appropriated
for the year of 1974 from the Federal Assistance Grant Fund, commonly known as
the General Revenue Sharing Funds. This appropriation is to be administered
by the Department of Law and will be distributed as set forth below:

SECTION II. This Ordinance shall be in full force and effect
from and after its passage by the Common Council, approval by the Mayor, and the
fulfillment of all statutory requirements for emergency funding.

Joseph T. Serge, Terry S. Miller, Roger 0. Parent, Robert G. Taylor,
Walter T. Kopczynski, Frank Horvath
Re: Additional Deputy.
The Police Department has had a full time attorney during the
past year who has provided advice and assistance to them in
matters of criminal and civil law. This attorney will not be
there in 1974.
I would like to hire a part time deputy to continue this work.
He would work under my supervision. I would intend that he meet
on a weekly basis with groups of officers to advise them in the
areas of arrests, search and seizure, interrogation, evidence,
etc.
All of these areas are concerned with criminal law but civil
law is also involved. If an arrest is improper or if excessive
force is used, the City of South Bend can be liable.
A good attorney can save the City a serious lawsuit by timely
advice to the police. He also could assist in the effort to
reduce crime by telling the police what they can do in order to
make a good arrest which will result in a conviction.
For these reasons, I recommend that this attorney be hired.
