GAMMON Clerk Merry Avenue Project ORDINANCE NO, SG /,?-17,3 AN ORDINANCE AMENDING ORDINANCE NO. 5372-71, AS AMENDED COMMONLY KNOWN AS THE ZONING ORDINANCE OF THE CITY OF SOUTH BEND, INDIANA, CHAPTER 21 OF THE CITY CODE OF THE CITY OF SOUTH BEND, INDIANA, 1971 BE IT ORDAINED BY THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA. Section 1. Ordinance No. 5372 -71, as amended, which ordinance is commonly known as the Zoning Ordinance of the City of South Bend, Indiana, be and the same hereby is amended in order that the zoning classification of the following- described real estate in the City of South Bend, St. Joseph County, State of Indiana: Lots Numbered 1 through 42 of Arnold's 1st Addition, more particularly described as follows: Beginning at a point formed by the intersection of the West right -of -way line of Grant Street and the South right -of -way line of Washington Street; thence West along the South right -of -way line of Washington Street to a point of intersection of the South right -of -way line of Washington Street and the East right -of -way line of Olive Street; thence South along the East right - of -way line of Olive Street to a point of intersection of the Southwest right -of -way line of Merry Avenue extended; thence Southeast along the Southwest right - of -way line of Merry Avenue; thence East along the South right -of -way line of Merry Avenue to a point of inter- section of the South right -of -way line of Merry Avenue and the West right -of -way line of Grant Street; thence North along the West right -of -way line of Grant Street to the place of beginning; be and the same hereby is, changed in its Use District Regulation classi- fication from "E" Heavy Industrial to "D" Light Industrial with no change in its Height and Area District Classification. Section 2. This ordinance shall be in full force and effect from and after its passage by the Common Council, approved by the Mayor, and its publication according to law. Section 3. INDIANA 40801 (219) 289 -.SD November 21, 1973 The Honorable Common Council City of South Bend County -City Building South Bend, Indiana In Re: A proposed ordinance and site development plan of the Department of Redevelopment to zone from "T" Heavy Industrial, "F" Height and Area, to "D" Light Industrial, "F" Height and Area, property located at and bordered by Washington Street, Grant Street, and Merry Avenue, City of South Bend Gentlemen: The attached rezoning petition of the Department of Redevelopment was legally advertised November 10, 1973 and November 17, 1973. The Area Plan Commission gave it a public hearing November 20, 1973, at which time the following action was taken: "Upon a motion made by Rollin Farrand, seconded by Garrett Mullins and carried, the petition of the Department of Redevelopment to zone from "E" Heavy Industrial, "F" Height and Area, to "D" Light In- dustrial, "F" Height and Area, is returned to the Common Council with a favorable recommendation subject to a final site plan, by the Area Plan Commission." The above recommendation is made subject to a final site plan and the preliminary site plan is attached hereto. The deliberations of the Area Plan Commission and points considered in arriving at the above decision are shown in the minutes of that public hearing and will be forwarded to you at a later date to be made a part of this report.
