GAMMON Clerk ORDINANCE NO. 5-7 (o a - AN ORDINANCE APPROPRIATING THE SUM OF $201,925.00 FROM THE FEDERAL ASSISTANCE GRANT FUND TO VARIOUS ACCOUNTS WITHIN THE F.A. PROGRAM 45 "CIVIC CENTER AUTHORITY" TO BE ADMINISTERED BY THE DEPARTMENT OF PUBLIC WORKS OF THE CITY OF SOUTH BEND, INDIANA. WHEREAS, certain extraordinary conditions have developed since the adoption of the existing budget for F.A. Program 45 "Civic Center originally appropriated for the Civic Center Authority" so that it is now necessary to appropriate more money that was originally appropriated for the Civic Center Authority to carry out its governmental functions; and WHEREAS, $32,945.00 was appropriated in 1973 for F.A. Program 31 for certain promotional, salary and related expenses and should have been re- appropriated in Ordinance No. 5626 -74 but was not; and WHEREAS, additional funds totalling $168, 980.00 are now needed for architectural fees, construction management fees, and demolition; NOW, THEREFORE BE IT ORDAINED by the Common Council of the City of South Bend, Indiana: SECTION I. That the sum of $201,925.00 be, and hereby is appropriated from the Federal Assistance Grant Fund to F.A. Program 45, "Civic Center Authority ", to be administered by the Department of Public Works as set forth below: F.A. 45 "Civic Center Authority" Services Personal 110.00 Services Contractual 214.0 260.0 "Salaries" $ 2,950.00 "Telephone" 500.00 "Other Contractuals" Architectural Fees 120,000.00 Construction Management 48,000.00 Demolition 10,000.00 Total 260.0 Other Contractuals $178,000.00 261.0 Promotional Expense 20,300.00 TOTAL SERVICES CONTRACTUAL $198,300.00 Current Obligations 620.0 "Social Security" 175.00 TOTAL F.A. 45 y$201,925.00 SECTION II. This Ordinance shall be in full force and effect from and after its adoption by the Common Council, its approval by the Mayor and the fulfillment of all statutory requirements. Director, Public Works October 99 1974 Members of the Common Council County /City Building & South Bend, IN 46601 Gentlemen: i E I respectfully submit for your consideration the following ordinances: 1. An Ordinance Establishing the Century Center Con- I struction Fund and Appropriating $616,000.00 ! from the Development Fund. f It is necessary to establish a new fund for the construction of the Century Center since the existing fund is a trust fund only, and disbursements were not meant to be made from it. The $616,000 being appropriated is actually a transfer of current receipts and monies to be received by December 31, 1974, to the Con- struction Fund. The following ordinance is the actual appropriation ordinance for construction. 2. An Ordinance Appropriating $1,100,000.00 from the Century Center Construction Fund to Phase I Con - struction, Account 710.0. As you will note, this money is required for the first four contracts of construction to be let yet this year. The source of the funds will be a combination of gifts and donations and EDA Funds, in addition to the $616 00 transferred by the above ordinance. 3. �An Ordinance Appropriating $2019925 from Revenue Sharing to F.A. Program 45 "Civic Center Authority ". + r Members of the Common Council Page 2 October 9, 1974 Of the amount requested, $32,945 were funds originally appropriated in 1973 but inadvertantly left off the re- appropriation ordinance passed earlier this year. These particular amounts are not actually "new" or additional funds. The remaining $168,000 is required for architectural fees for Johnson Burgee, Sollitt Construction Company management fees and an additive for } the demolition of the power house. The power house demolition was originally budgeted at $10,000, but the contract was for $40,000, of which $10,000 is still outstanding; the difference of $20,000 was paid for by the existing Other Contractuals Account in F.A. 45. Also paid for out of the existing Other Contractuals Account were Sollitt's fees. k As a net result, the above payments, coupled with the original under- budgeting of Johnson - Burgee fees, a shortage in Other Contractuals Account has occurred. E Even though the breakdown in the ordinance shows $120,000 for architec- tural fees, this does not mean an increase in the original estimate for these fees. 1 E I am at your convenience to discuss this with you in further detail. c Very truly yours, t Rollin E.
