AN ORDINANCE ESTABLISHING THE CENTURY CENTER
CONSTRUCTION FUND AND APPROPRIATING TO THIS
FUND $616,000.00 FROM THE CIVIC CENTER DEVELOP-
MENT FUND, BOTH FUNDS BEING WITHIN THE FUNDS OF
THE CIVIL CITY OF SOUTH BEND, INDIANA.
WHEREAS, the Civic Center Development Fund of the Civil
City of South Bend, Indiana was established by Ordinance in
order to receipt donations made for the purposes of building a
convention, arts and cultural facility, and
WHEREAS, the expenditures of these donations and
other receipts require the establishment of a special
operations fund for the purposes of constructing this facility;
NOW, THEREFORE BE IT ORDAINED by the Common Council
of the City of South Bend, Indiana:
SECTION I. That there be, and hereby is established
a new fund of the Civil City of South Bend, to be known as
the Century Center Construction Fund.
SECTION II. That the sum of $616,000.00 be, and
hereby is appropriated from the Civic Center Development Fund
to the Century Center Construction Fund.
SECTION III. That all future monies, other than
donations, gifts and bequests, given for the construction of the
Century Center be receipted to the Century Center Construction
Fund in order to be appropriated for such construction.
SECTION IV. This Ordinance shall be in full force
and effect from and after its adoption by the Common Council,
its approval by the Mayor, and the fulfillment of all statutory
requirements.

I respectfully submit for your consideration the following ordinances:
An Ordinance Establishing the Century Center Con-
struction Fund and Appropriating $616,000.00
from the Development Fund.
It is necessary to establish a new fund for the construction of the
Century Center since the existing fund is a trust fund only, and
disbursements were not meant to be made from it.
The $616,000 being appropriated is actually a transfer of current
receipts and monies to be received by December 31, 1974, to the Con-
struction Fund. The following ordinance is the actual appropriation
ordinance for construction.
2. An Ordinance Appropriating $1,100,000.00 from the
Century Center Construction Fund to Phase I Con-
struction, Account 710.0.
As you will note, this money is required for the first four contracts
of construction to be let yet this year. The source of the funds will
be a combination of gifts and donations and EDA Funds, in addition to
the $616,000 transferred by the above ordinance.
3. An Ordinance Appropriating $201,925 from Revenue
Sharing to F.A. Program 45 "Civic Center Authority"

Of the amount requested, $32,945 were funds originally appropriated in
1973 but inadvertantly left off the re- appropriation ordinance passed
earlier this year. These particular amounts are not actually "new"
or additional funds.
The remaining $168,000 is required for architectural fees for Johnson -
Burgee, Sollitt Construction Company management fees and an additive for
the demolition of the power house. The power house demolition was
originally budgeted at $10,000, but the contract was for $40,000, of
which $10,000 is still outstanding; the difference of $20,000 was paid
for by the existing Other Contractuals Account in F.A. 45. Also paid
for out of the existing Other Contractuals Account were Sollitt's fees.
As a net result, the above payments, coupled with the original under -
budgeting of Johnson - Burgee fees, a shortage in Other Contractuals
Account has occurred.
Even though the breakdown in the ordinance shows $120,000 for architec-
tural fees, this does not mean an increase in the original estimate for
these fees.
