AN ORDINANCE APPROPRIATING $17,500.00 FROM THE GENERAL
ASSISTANCE GRANT FUND, COMMONLY REFERRED TO AS GENERAL
REVENUE SHARING, FOR THE PURCHASE AND INSTALLATION OF
GASOLINE DISPENSING EQUIPMENT TO BE LOCATED AT 701 WEST
SAMPLE STREET.
WHEREAS, additional funds are needed by the Department of Public Works
to supply a needed improvement at the Municipal Services Facility, so that its
functions may be carried during 1975•
NOW THEREFORE, BE IT ORDAINED by the Common Council of the City of South
Bend, Indiana as follows:
SECTION I. That the sum of $17,500.00 is hereby appropriated for the
Federal Assistance Grant Fund, commonly known as the General Revenue Sharing
Trust Fund. This appropriation is to be administered by the Department of
Public Works through its Bureau of Building Maintenance (MSF) and will be
distributed as set forth below.

All vehicles purchased by the City which are 1975 or later models,
in accordance with current Federal Law and Regulation, must use non-
leaded gasoline. It is our understanding that it is illegal to modify
these cars to use leaded gasoline.
This matter has been checked with Mr. Ralph J. Kuchle, Service
Manager of the Chevrolet Motor Division in South Bend. He stated
that as far as he knew it was unlawful to modify the 1975 models
to use leaded fuel.
We also checked the Federal Clean Air Act as amended June 24, 1974.
This Federal statute explicitly forbids manufacturers or dealers from
making any such modifications. (See Clean Air Act, Section 203 (a),
Paragraph 3.) The Indiana State Law, however, goes even further and
states, "except as permitted or authorized by law, no person shall fail
to maintain in good working order or remove, dismantle or otherwise
cause to be inoperative any air pollution control system or mechanism
which is used solely to control air pollution of a motor vehicle..."
(Chapter 357, Acts of 1969 of the General Assembly of the State of
Indiana, Section 4b (b).

It is obvious that we will be required to provide non - leaded gasoline
and leaded gasoline starting with delivery of 1975 model cars. There
is, of course, one possible alternative. This would be to modify older
cars to use non - leaded gasoline. Investigation in this area has
indicated that this modification would result in damage to the engines
of the older model cars, particularly those older than 1971• It should
be noted that City fleets include many pieces of heavy equipment that
go back to the early 1960's.
With the installation of a new gasoline tank, additional pumping
facilities will be required. We are requesting an appropriation to
provide for two Key -trot Pumps, identical to those now installed.
The Key -trot Pumps have been successful in eliminating theft of gasoline
at the Municipal Services Facility. We feel that for this reason alone
their use is justified. In addition, we are able to keep more accurate
cost records on each vehicle through this method of recording gasoline
usage. At the present time the number of slots is insufficient to permit
us to isolate every vehicle in the City fleet. These additional slots
will permit us to keep the detailed records for more individual vehicles.
We would appreciate your favorable consideration of this request for
appropriation for additional gasoline storage and pumping facilities.
