ORDINANCE NO. 5- -7aa -7 /
AN ORDINANCE TO APPROPRIATE $10,000 FROM THE
CUMULATIVE CAPITAL IMPROVEMENT FUND, LINE ITEM
260.0 AND $90,000 FROM THE LOCAL ROAD AND
STREET FUND TO PROJECT R & S 60 ORANGE STREET -
COLFAX STREET CONNECTOR, WITHIN THE LOCAL ROADS
AND STREETS FUND.
WHEREAS, there was enacted during the 1969 Session of the Indiana
General Assembly an Act, Chapter 392 of the Acts of 1969, making avail-
able to cities, towns and counties for engineering, construction or
reconstruction of roads, streets and bridges under local jurisdiction,
certain additional funds to be derived from the 7th and 8th cents of
Indiana motor fuel tax and fuel use tax and from increases in fees
levied under the Motor Vehicle Act, and
WHEREAS, no appropriation of such funds was included in the regular
1974 budget for the Civil City of South Bend, Indiana; and
WHEREAS, an emergency exists requiring the appropriation and
expenditure of certain of said funds already received or to be received
before the end of the year; and
WHEREAS, funds are to be appropriated for the City's matching share
from the Cumulative Capital Improvement Fund.
NOW, THEREFORE, BE IT ORDAINED by the Common Council of the City
of South Bend, Indiana:
SECTION I. The following sums of money are hereby appropriated
and ordered set apart out of the Local Road and Street Fund and the
Cumulative Capital Improvement Fund for the purpose of right -of -way
purchase on the following project:

SECTION II: This Ordinance shall be in full force and effect from
and after its passage and approval as required by law.

Through the accompanying Ordinance, we are asking you to appropriate
$100,000,00 to be used in acquiring right -of -way, for the Orange - Colfax
Streets Connector (R &S 60). Because this project is being developed to
use approximately $290,000 of Federal Aid Urban Funds for construction,
we will not be in a position to proceed with construction until the
first of next year.
We are, however, in a position to proceed with necessary acquisition of
right -of -way using other funds.
These funds now being requested will enable the Department of Public
Works to begin this process.
