AN ORDINANCE ANNEXING TO THE CITY
OF SOUTH BEND CERTAIN TERRITORY
CONTIGUOUS THERETO (Clay, German
or Portage Township).
BE IT ORDAINED BY THE COMMON COUNCIL OF THE CITY
OF SOUTH BEND, INDIANA:
SECTION I. That the following described territory
contiguous to the incorporated City of South Bend, Indiana, in Clay,
German or Portage Township, St. Joseph County, to -wit:
Beginning at a point in the south right -of -way
line of Grant Road approximately a quarter of
a mile west of Mayflower Road which point is
in the present city limits line;
thence; west along the south right -of -way line of Grant
Road to the intersection with the westerly right -
of -way line of the U.S. 20 By -Pass,
thence; northerly along the westerly right -of -way line
of U.S. 20 By -Pass to a point 400 feet south
of the south right -of -way line of Lincoln Way
West (U.S. 20) measured at right angles,
thence; westerly along a line 400 feet south of measured
at right angles, and parallel to the south right -
of -way line of Lincoln Way West to the point of
intersection with the centerline of Olive Road
extended to the south,
thence; due north along the centerline of Olive Road
extended to the south to the centerline of Lincoln
Way West (U.S. 20),
thence; southeasterly along the centerline of Lincoln Way
West (U.S. 20) to the point of intersection with
the easterly right -of -way line of Olive Road
extended to the south,
thence; due north along the easterly right -of -way line
of Olive Road extended to the south and the
easterly right -of -way line of Olive Road, and
the easterly right -of -way line of Olive Road
extended to the north to a point 690 feet north
of the centerline of Brick Road,
thence; due east along a line 690 feet north of and
parallel to the centerline of Brick Road to the
point of intersection with the easterly right -
of -way line of Portage Road Highway,
thence; northwesterly along the easterly right -of -way
line of Portage Road Highway to the point of
intersection with the south right -of -way line
of Auten Road,
thence; due east along the south right -of -way line of
Auten Road to the intersection of center line
of Kenilworth Road which center line is also
the east line of Section 14, Twp. 38 North,
Range 2 East,
thence; due south along the east line of said Section
14 to the southeast corner of said Section 14,
thence; due west along the south line of said Section
14 to the southwest corner of said Section 14,
thence; to the northeast corner of Section 22, Twp. 38
North, Range 2 East,
thence; due west along the north line of said Section
22 to the point of intersection with the west
right -of -way line of Lilac Road,
thence; south along the west right -of -way line of Lilac
Road a distance of approximately 30 feet to the
south right -of -way line of Brick Road,
thence; due west along the south right -of -way line of
Brick Road a distance of approximately 1300 feet
more or less to the intersection with the present
city limits line,
thence; meandering along the present city limits line gen-
erally in a southerly direction as set forth
in parts of the following listed annexation
ordinances:

German or Portage Twp., St. Joseph County,
Indiana, containing 7,289 acres or 11.39 square
miles.
Subject to all legal highways.
be and the same is hereby annexed to said City of South Bend, all
of which contiguous territory shall hereafter form a part of the
said City of South Bend and be within its jurisdiction, and said
territory is hereby consolidated with and made a part of the said
City of South Bend.

IiE SOLUTION No. 14, 1974
WHEREAS, t:ie Common Council of the City of South Bend
has by ordinance proposed annexation of certain real estate contain-
ing territory in Clay, German and Portage Townships, St. Joseph
County, Indiana; and
WHEREAS, the City of South Bend has need in the reasonably
near future for land suitable for additional industrial and
commercial development; and
WHEREAS, the City of South Bend has need in the reasonably'
near future for undeveloped land suitable for additional residential
development,; and
WHEREAS, land use analysis of St. Joseph County for future
industrial and commercial development projects such development in
the area in the vicinity of the St. Joseph County Airport, and the
Intersection of the U.S. 20 bypass as such bypass extension is
projected and the Northern Indiana Toll Road; and
WHEREAS, land use analysis of St. Joseph County for future
residential development projects residential development in the

argely undeveloped area north of the Northern Indiana Toll Road, and
.rest of the projected extension of the U.S. 20 bypass; and
WHEREAS, the above enumerated industrial, commercial and
residential areas are included in the territory described in said
annexation ordinance; and
WHEREAS, the Board of Public Safety now desires to establish
and adopt a fiscal plan and establish a definite policy to furnish
to said territory to be annexed within period of three (3) years,
governmental and proprietary services substantially equivalent in
standard and scope to the governmental and proprietary services
furnished by the City to other areas of the City which have charac-
teristics of topography, patterns of land utilization and population
density similar to said territory.
NOW, THEREFORE, BE IT RESOLVED by the Board of Public Safety
of the City of South Bend:
SECTION 1. The real estate described in the annexation
ordinance attached hereto and made a part hereof is needed and can be
a-ed by the City of South Bend for its future development in the
reasonably near future.
SECTION 2. That all prior resolutions adopted by this Board
concerning annexation of real estate included in the territory
described 'herein are hereby rescinded.
BCTIQPi 3. It is now Hereby declared and established that

a.y.thln a p +riod of tnree (;) years governmental and proprietary
services substantially equivalent in standard and scope to the govern -
mantal and proprietary services furnished by the City to other areas
of the City which have characteristics of topography, patterns of
lend utilization and population density similar to said territory,
and that such services, among others, shall include street maintenance,
traffic control, street lighting, sanitation service and sewer service.
SECTION 4. The Board of Public Safety now establishes the
following; timetable for the furnishing of such governmental services:
A. Police protection will be furnished immediately upon the
effective date of the annexation ordinance by the existing police
force and equipment of the City of South Bend. It is estimated that
based upon the ratio of policemen to population currently in effect
in the City of South Bend that 8.3 additional
squired to be added to the Policemen would be
= 'I police force of the City. The additional
9 policemen which would be required could be hired within 90 days
of the effective date of the annexation ordinance and would go into
training at the date of the next police academy training school which
would be during the calendar year 1975 and would result in graduation
and full employment by the force during the present calendar year.
B. Fire protection would be provided to the territory immediately
upon the effective date of the annexation. All alarms would be
answered by the existing fire force of the City. It is proposed that
a new fire station would be built. Five additional pieces of equip-
ment would be required to service the area and 10 additional firemen
would be required. The firemen are provided for in the present City
budget and could be on active duty after the training period. The
additional fire station could be provided within 18 months of the
effective date of the annexation if population growth and development
within the area would require. Additional equipment could be
purchased to service the area within approximately 6 to 9 months of
the effective date of the annexation.
SECTION 5. The Board of Public Safety now establishes and
adopts the ol�g fiscal plan for the furnishing of such services:
A. Cost of salary and equipment for one additional policeman
In the City of South Bend is $14,000. Estimated annual cost of provic-
ing 8.25 policemen as estimated in the cost analysis for this annex-
ation is $115,584. The first two years of this cost of additional
policemen would be funded from revenue sharing funds which are avail-
able to the City for such purpose. Thereafter, the police department
budget would include from the general tax revenues of the City and /or
from the tax revenues realized from the annexation of this territory,
sufficient funds to finance this expenditure.

B. It is estimated that based upon the present manpower,
of the fire force of the City no additional firemen would be
required to man the proposed new fire station and its equivalent
or any of the additional equipment to be provided or as proposed
in the event of future development. No additional cost for
firemen's salaries would thus be incurred.
C. Cost of construction of a new fire station is estimated
at $175,000 which could be financed over a 25 year period by the
City. Based upon 6% interest, the amortized.cost of such construc-
tion would be $13,700 per annum. Funding would be available by
means of general obligation bond issue.
D. Additional fire fighting equipment would consist of one
engine pumper, two satellite tankers /hose tenders, two attack /grass
fire units at a total cost of $144,000. Cost of this equipment
could be financed by a lease purchase contract and such cost could .
be amortized over a 10 year period at 5% interest per annum at an
annual cost of $199600. Funding could come from revenue sharing
funds in the first two years and tax revenue to be collected from
the area thereafter.
SECTION 6. The Board of Safety determines that the
revenue to the ty to be anticipated from such annexation will be
derived from the following:
A. Property tax revenue as based upon assessed valuation of
$4,642,050 would produce $2339959.32 per year to be derived from
tax payment made annually beginning with 1975 payable 1976 taxes.
B. Revenue from distribution of state collected taxes from
motor vehicle highway tax, special $.02 motor vehicle highway tax,
cigarette tax to general fund and cigarette tax to cumulative
capital improvement fund is estimated at $21.06 per capita for a
total available distribution of $94,496.22.
C. Estimated revenue sharing distribution from the federal
government based upon present revenue sharing would be in the
amount of $68,023 per annum.
D. Total estimated revenue from the territory to be annexed
would be $396,478.54.

E. Total cost of services to be furnished to the area to
be annexad, including all proprietary services and governmental
services for fire and police protection as herein enumerated,
together with allowance for 10% governmental overhead expense of
$35,889.30, would be $394,782.30.
