ORDINANCE NO. 5794 -75
AN ORDINANCE AMENDING CHAPTER 2 OF THE
MUNICIPAL CODE OF THE CITY OF SOUTH
BEND, INDIANA, PERTAINING TO THE
EXECUTIVE BRANCH OF GOVERNMENT.
BE IT ORDAINED by the Common Council of the City
of South Bend, Indiana, as follows:
SECTION 1. Section 2 -21 (c) of Article 4 of
Chapter 2 of the Municipal Code of the City of South Bend,
Indiana, shall be amended to read as follows:
(c) The director of each department
shall be responsible for the direction of
all duties and functions of all agencies
within the department and for the coordina-
tion of related duties and functions between
or among agencies within the department.
The Director of Public Safety
shall coordinate activities of the police
and fire forces with other departments
and agencies, provide research and grant
supervision, and shall also serve as a
member of the Board of Safety. In no
event shall the Director of Public Safety
serve as the executive head of the police
or fire forces.
The Chief of Police shall have
exclusive direction and control of the
police force, and the Chief of the fire
force shall have exclusive control and
charge of such fire force, subject to the
rules and regulations and orders of the
Board of Public Safety.
SECTION 2. This ordinance shall be in full force
and effect from and after its passage by the Common Council and
approval by the Mayor.

Respectfully report that they have examined the matter and that in their opinion the Ordinance should be
recommended favorably to the Common Council, as amended:
Amend the word "may" to "shall" in the fourth line of
the second paragraph in (c).
