ORDINANCE NO.
AN ORDINANCE APPROPRIATING THE SUM OF $306,365.58
TO THE GENERAL IMPROVEMENT FUND AS PAYMENT OF THE
CITY'S ASSESSMENT ON THE PROJECT ENTITLED "PORTAGE
GARDENS LOCAL SEWERS AND LINDEN AVENUE TRUNK SEWERS.
WHEREAS, the Portage Gardens Local Sewers and Linden
Avenue Trunk Sewers have been constructed pursuant to a contract
between H. DeWulf Mechanical Contractor, Incorporated, and the
Civil City of South Bend; and
WHEREAS, the City of South Bend was assessed in the
amount of $306,365.58, for its 50•� portion of this Barrett Law
Project; and
WHEREAS, funds are now needed to pay the city's share of
the assessed cost of said construction; and
WHEREAS, a Cumulative Sewer Building and Sinking Fund
has been established.
NOW, THEREFORE, BE IT ORDAINED by the Common Council of
the City of South Bend, Indiana:
SECTION I. That the sum of $306,365.58 be appropriated
from the Cumulative Sewer Building and Sinking Fund for the project
and in the amount set forth below:
Portage Gardens Local Sewers and Linden Avenue
Trunk Sewers - - $306,365.58.
SECTION II. This Ordinance shall be in full force and
effect from and after its passage by the Common Council, its
approval by the Mayor and the fulfillment of all statutory require-
ments.

Sanitary sewers were installed in the Portage Gardens Subdivision on
the west side of South Bend and a trunk sewer was installed on Linden
Avenue. This installation is part of the overall plan to provide or
offer to provide sewers to the residents of South Bend at approximately
50% of the cost.
This project is complete and many residents have already availed them-
selves of the new service.
We are now requesting the 50% City share of the local sewer and 100% of
the trunk sewer cost which results in a total cost of $306,365.58. We
would also like to point out that the Barrett Law work for this project
was done by the Department of Public Works and thus, the residents and
the City were saved an estimated 10% of the construction cost.
