AN ORDINANCE APPROPRIATING $5,526.00 FROM
THE FEDERAL ASSISTANCE GRANT COMMONLY
REFERRED TO AS GENERAL REVENUE SHARING,
FOR VARIOUS LAW ENFORCEMENT PROGRAMS, TO
BE ADMINISTERED BY THE CITY OF SOUTH
BEND THROUGH ITS DEPARTMENT OF LAW.
WHEREAS, additional funds are needed by the Department
of Law to administer certain law enforcement programs and to insure
the department's ability to properly perform its functions during the
year of 1975.
NOW, THEREFORE, BE IT ORDAINED by the Common Council
of the City of South Bend as follows:
SECTION I. That the sum of $5,526.00 is hereby
appropriated for the year of 1975 from the Federal Assistance Grant
Fund, commonly known as the General Revenue Sharing Fund. This
appropriation is to be administered by the Department of Law and
will be distributed as set forth below:

RE: Additional Deputy City Attorney
January 21, 1975
Last year at this time, the Department of Law requested and was
granted approval for an additional Deputy City Attorney to be paid from
revenue sharing funds. It was our stated intent that this Deputy would
be specifically assigned to handle matters at the Police Department.
As events developed, however, this Deputy was never hired and the City
Attorney's Salary Budget was netted at year's end with the amount of
revenue sharing funds alloted.
During the spring and early summer months, the City experienced
a sharp increase in citizen complaints of illegal police activity and
corruption allegations with subsequent investigations against the
Police Department. During this period, it was more feasible for me
to oversee these procedures personally than to hire and break in a
new Deputy unfamiliar with the circumstances.
Deputy Attorney Kathleen Cekanski and Intern Robert Bray assisted
me in conducting the inquiries, research and recom endations surrounding
the corruption investigations while their work loads were re- assigned
among the legal staff. This increased work load on the remaining depu-
ties was further compounded in early fall with the resignation of
Deputy Attorney Lewis Laderer.
At the termination of the investigations, Intern Bob Bray was
requested by the Police Department to serve as a temporary advisor until
a suitable attorney applicant could be found and hired. Bray has since
worked with the police under my guidance for approximately twenty hours
a week researching and analyzing intradepartmental police problems and
citizen complaints against the Police Department. Bray has recently
returned to my office to complete some long standing projects before
his graduation from law school. The end result after considerable
shuffling of personnel and shifting of work loads is the Police Depart-
ment is still without a Deputy or legal advisor and my request for a
renewal of funds for this Deputy still remains.
This new Deputy will work directly under my supervision and will
be available to give officers or groups of officers advice and guidance
in areas such as lawful arrest, search and seizure, confessions, evidence
gathering and other sensitive areas of law enforcement when proper pro-
cedures are crucial to the success of a case. Availability of an attorney
to talk informally with officers on the above topics will help profession-
alize the Department as well as prevent potential civil suits against the
City. This Deputy would also handle or assist in handling inquiries and
questioning of all concerned parties when citizens allege questionable
police activities as well as taking care of police insurance requirements
and related legal matters.
For the above reasons, I highly recommend that a new deputy
assigned solely to the Police Department and responsible solely for
police problems be hired.
