AN ORDINANCE AMENDING ORDINANCE NO. 4990 -68, AS
AMENDED, COMMONLY KNOWN AS THE ZONING ORDINANCE OF
THE CITY OF SOUTH BEND, INDIANA (Chapter 21, Municipal
Code).
BE IT ORDAINED by the Common Council of the City of South
Bend, Indiana:
Section 1. Ordinance No. 4990 -68, as amended, which ordinance
is commonly known as the Zoning Ordinance of the City of South Bend,
Indiana, be and the same hereby is amended in order that the zoning clas-
sification of the following described real estate in the City of South Bend,
St. Joseph County, State of Indiana:
and known as being the Easterly 218.6 feet of Lots No. 31,
32 and 33, and the Easterly 218.6 feet of a vacated alley
located South of and adjacent to Lot No. 33; alos Lot No. 34,
excepting a parcel 33 feet, north and south, and 125 feet east
and west, at the approximately 66 feet east and west, by 198
feet north and south, lying West of and adjacent to Lots 34,
35 and 36; also, an irregular shaped parcel, 58.2 feet along
LaSalle Street by 128.5 feet North and South, lying West of
the East Mill Race. Also, 7.5 feet of vacated alley located
North of and adjacent to the Westerly 110 feet of Lot No. 34,
all as shown in the Original Plat of Lowell, Portage Township,
Section 12, City of South Bend, Indiana. See attached
Addendums marked Exhibits A and B, attached and made a part of
this option.
Be and the same is hereby established as multiple dwellings and 15 story height.
Section Z. This Ordinance shall be in full force and effect from
and after its passage by the Common Council, approval by the Mayor and legal
publication.

I (We), the undersigned, do hereby respectfully make applica-
tion and petition the Common Council of the City of South Bend, Indiana,
to amend the Zoning Ordinance of the City of South Bend as hereinafter
requested, and in support of this application, the following facts are
shown:
1. The property sought to be rezoned is located at:
LaSalle, Niles and Monroe Streets
2. The property is owned by:
Indiana and Michigan Electric Company
3. A legal description of the property is as follows:
Situated in the Township of Portage,.County.of St. Joseph, and
State of Indiana, and known as being the Easterly 218.6.feet of
Lots No. 31, 32 and 33, and the Easterly 218.6 feet of a vacated
alley located South of and adjacent to Lot No. 33; also`Lot No. 34,
excepting a parcel 33 feet, north and south, and 125 feet east and
west; at the Southeast corner of said Lot. Also; all of the East
Mill Race being approximately.66 feet east and west, by 198 feet
north and south, lying West of and adjacent to Lots 34, 35 and 36;
also, an irregular shaped parcel,. 58.2 feet along LaSalle Street

Indiana and Michigan Electric Co. and Lake States
Associates, Inc. to zone from "D" Light Industrial,
"F" Height and Area, to "A -3" High Density Residential
Office and Professional District, property located on
the west side of Niles Avenue, between Madison Avenue
and LaSalle Street, City of South Bend
Gentlemen:
The attached rezoning petition of Indiana and Michigan
Electric Co. and Lake States Associates, Inc. was legally adver-
tised August 9, and August 16, 1975. The Area Plan Commission
gave it a public hearing on August 19, 1975, at which time the
following action was taken:
"Upon a motion by Ted Sharp, being seconded by
Robert Lehman and carried, the petition of Indiana

AUG 2 01975 and Professional District, property located on the
west side of Niles Avenue, between Madison Avenue and
LaSalle Street, is returned to the Common Council with
Irene Gammon a favorable recommendation, subject to the issuance of
Oft CtA,VM Mgo1NOa parking variance by the Board of zoning Appeals and to
a final site plan, by the Area Plan Commission."
The above recommendation is made subject to a final site
plan and the preliminary site plan is attached hereto.
The deliberations of the Area Plan Commission and points
considered in arriving at the above decision are shown in minutes
of the public hearing and will be forwarded to you at a later date
to be made a part of this report. Attached for your consideration
in the review of this matter is the Area Plan Commission Staff Report.

EXISTIIG ZONING 01' SURROUNDING PROPERTY - The property on all
four sides of this site -is currently zoned "D"
Light Industrial.
EXISTING LAND USE OF SURROUNDING PROPERTY - The property on
all four sides of the site is currently being
used for commercial and industrial uses or is
vacant land.
SITE PLAN -- The site plan proposes to construct a 15 story,
225 unit structure for housing the elderly. The
building would be constructed under Section 8 of
the Federal Rousing Program.
ACCESS - Access to the site would be through four points:
one on Madison Avenue, two on Niles Avenue, and
one on LaSalle Street. No State approvals would
be required for these curb cuts; however the City
Engineer's approval would be needed.
DRAINAGE - No drainage plans have been submitted with this
rezoning. City Standards, however, require that
all storm water be retained on the site or be
diverted into a storm sewer system. This problem
nust be solved prior to final site plan approval.
PARKING - The site plan as submitted indicates 75 parking
spaces to be provided. The South Bend City Zoning
Ordinance requires that one parking space be pro-
vided for each unit. The petitioners do have some
additional land available to provide additional
parking spaces, however, they would still be short
of the required number. The petitioners have
indicated that they crculd go to the Board of Zoning
Appeals to seek a variance from the required parking
spaces. Any recommendation made by the Area Plan
Commission rmst be subject to this variance being
granted.
TABULATED DATA - The total site is approximately 88,480 square
feet or 2.03 acres, more or less. The building
will occupy approximately 12.5% of the site, the
parking and drives will occupy approximately 43.5%
and the remaining 44% will be left in landscaping
and open areas.
PRELIMINARY SITE PLAN - The site plan as submitted does not
have sufficient data to be considered a final site
plan, therefore, any recommendation by the Area
Plan Commission to the City Council must be subject
to a final site plan.
AGENCY COMMENTS - The Director, Department of Natural Resources,
Mr. Joseph D. Cloud, has sent a letter indicating
that this does not appear to be in the floodway of
the St. Joseph River. Therefore, the approval of
the Natural Resources ConxAssion will not be required.
