AN ORDINANCE AMENDING ORDINANCE NO. 4990 -68,
AS AMENDED, COMMONLY KNOWN AS THE ZONING
ORDINANCE OF THE CITY OF SOUTH BEND, INDIANA
(Chapter 21, Municipal Code).
BE IT ORDAINED by the Common Council of the City of
South Bend, Indiana:
Section 1. Ordinance No. 4990 -68, as amended, which
ordinance is commonly known as the Zoning Ordinance of the City
of South Bend, Indiana, be and the same hereby is amended in
order that the zoning classification of the following described
real estate in the City of South Bend, St. Joseph County, State
of Indiana:
A part of lots 10, 11, and 12 of the Original
Plat to the Town of Lowell, now the City of
South Bend, Indiana and a portion of the
vacated first alley running East of Sycamore
Street to the East Race, Which alley is the
first alley North of and parallel to LaSalle
Avenue in the City of South Bend, Indiana;
the first alley vacated East of Sycamore
Street running North and South to the first
alley North of the North line of LaSalle
Avenue; and a part of lots 27, 28, and 29
of the plat of Miller and Green's Second
Addition to the town of Lowell, now the City
of South Bend, Indiana and a part of the
West leg of the East Race, and the above
several parcels are more particularly de-
scribed as bounded by a line running as fol-
lows, viz:
Beginning 86 feet East of the East line of
vacated Sycamore Street on the North line of
East LaSalle Avenue, in the City of South Bend,
Indiana; thence North 323.69 feet (bearing
assumed North); thence North 390- 30' -00" West
96.69 feet; thence North 500- 09' -31" East 92.00
feet; thence South 390- 30' -00" East 101.30 feet;
thence North 790- 28' -56" East 7.00 feet; thence
South 760- 42' -16" East 13.15 feet; thence South
56 - 41' -29" East 21.48 feet; thence South 270-
46'-40" East 179.62 feet; thence South 370 -07'-
00" East 16.18 feet; thence South 270- 10' -00"
East 34.73 feet; thence South 220- 54' -40" East
37.24 feet; thence South 00- 00' -20" West 128.50
feet; thence West 235.04 feet to the place of
beginning containing 1.835 acres more or less.

I (We), the undersigned, do hereby respectfully make
application and petition the Common Council of the City of
South Bend, Indiana, :to amend the Zoning Ordinance of the City
of'South Bend as hereinafter requested, and in support of this
application, the following facts are shown:
1. The.property sought to be rezoned is located at:

2. The property is owned by:
Millrace, Inc.
3. A legal description of the property is as follows:

In Re A proposed ordinance and site development plan of
Mill Race, Inc, to zone from "D" Light Industrial,
"F" Height and Area, to "A -3" High Density
Residential office and Professional District,
property located in the 300 block of East LaSalle
Street, City of South Bend
Gentlemen:
The attached rezoning petition of Mill Race, Inc.
was legally advertised July 5, and July 12, 1975. The
Area Plan Commission gave it a public hearing on July 15,
1975, at which time the following action was taken:
"Upon a motion by Rollin Farrand, seconded by
Ted Sharp and unanimously carried, the amendment
for Mill Race, Inca located in the 300 block of
East LaSalle Street, from 200 units to 184 units
is approved by the Area Plan Commission.
Motion was then made by Joseph Simeri, seconded
by Russell Rothermel and unanimously carried that
the petition of Mill Race, Inc. to zone from "D"
Light Industrial, "F" Height and Area, to "A -3"
High Density Residential office and Professional
District, property located in the 300 block of
East LaSalle Street, be returned to the Common
Council with a favorable recommendation by the
Area Plan Commission, subject to a final site
plan and subject to approval of a variance by the
Board of Zoning Appeals on required parking spaces."
The above recommendation.-is made subject to a final
site planuand the preliminary site plan is attached hereto.

forwarded to you at a later date to be made a part of
this report. Attached for your consideration in the
review of this matter is the Area Plan Commission

XI53 NG LAND USE OF SURROUNDING PROPERTY - The property on
c all four sides of the site is currently being used
for commercial and industrial uses or is vacant
land.
SITS PLAN ' = The site plan proposes to build a 13 story, 200
unit structure for housing the elderly. The
building would be constructed under Section 8 of
the Federal Housing Program.
ACCESS - Access to the site will be through two points:
on LaSalle Street and one on Hydraulic Avenue.
State approvals would be required, however, the
City Engineer's approval would be needed.

DRAINAGE - No detailed drainage plans have been submitted
the petition, however, all storm water must be
retained on the site per City standards. The
petitioner has indicated dry wells would be used
to meet this requirement.

PARKING - The site plan shows only 66 parking spaces for the
200 unit building. The South Bend City Zoning
Ordinance requires that one parking space be pro -
vided for each unit. The petitioner has stated
that they will go to the Board of Zoning Appeals
to get a variance on this requirement. Any
recommendation made by the Area Plan Commission
must be subject to this variance being granted.
TABULATED DATA - The size of the site is 1.8 acres, more or
less. The building will use approximately 15% of
the site, the parking and drive areas another 35 %,
and the remaining 50% will remain in open space.

1. Public sewer and water are available to this
site,
2. It is recommended that the developer consider
«-? the possibility of diverting storm water to the

'river through the old race.
3. No .indication has been made for loading zones.
A designated loading space should be shown for
waste removal, building maintenance, supplies,
etc.
4; Sufficient parking has not been provided according
to the South Bend City Zoning Ordinance.
This site does appear to be a desirable site for this
type of use. This Department would have no objections
to the proposal. The points raised above would appear
to be of a nature that can be resolved prior to final
site plan approval.
The Director of the Department of Natural Resources,
Mr. Joseph D. Cloud, has sent the Staff a letter
indicating that this site does not appear to be in
the floodway of the St. Joseph River. Therefore, the
approval of the Natural Resources Commission will not
be required.
STAFF. COMMENTS - This area has been designated as Residential
J. High Density and Office - Professional on the Land Use
and Transportation Plan. The proposed use would be
consistent with the Plan. in considering the merits
of this rezoning the following should be considered:
1. The current surrounding land uses are predomi-
nately industrial.
2. There are no food stores in the immediate vicinity.
3. All other shopping facilities are available to
the site.
4. Public transportation is available to the site.
