S JF-Y 8 7S AN ORDINANCE AMENDING ORDINANCE NO. 4990 -68, AS AMENDED, COMMONLY KNOWN AS THE ZONING ORDINANCE OF THE CITY OF SOUTH BEND, INDIANA (Chapter 21, Municipal Code). BE IT ORDAINED by the Common Council of the City of South Bend, Indiana: SECTION 1. Ordinance No. 4990 -68, as amended, which ordinance is c' ommonly known as the Zoning Ordinance of the City of South Bend, Indiana, be and the same hereby is amended in order that the zoning classification of the following described real estate in the City of South Bend, St. Joseph County, State of Indiana: Lots 8 and 9, Wenger and Kreighbaum Addition South Bend, Indiana be and the same is hereby established as "D" Light Industrial District and "D" Height and Area District. SECTION 2. Please be advised that, on July 14, the Council conducted its public hearing and considered the rezoning request. The Council favored the rezoning primarily because the projected use was an extension of the existing use, and voted to pass the ordinance rezoning the above property. On July 17, Mayor Miller approved and signed Ordinance No. 5848 -75 (a copy of which is enclosed). Publication of Ae ordinance will take place on July 25 and August 1. Ruge, to zone from "B" Residential, "B" Height and Area, to "D" Light Industrial, "D" Height and Area, property located at 503 E. Ohio Street, City of South Bend Gentlemen: The attached rezoning petition of Huron N. and Marjorie D. Ruge was legally advertised June 7, and June 14, 1975. The Area Plan Commission gave it a public hearing on June 17, 1975, at which time the following action was taken: "Upon a motion by Rollin Farrand, being seconded by Joseph Serge and carried, the petition of Huron N. and Marjorie D. Ruge, to zone from "B" Residential, "B" Height and Area, to "D" Light Industrial, "D" Height and Area, property located at 503 E. Ohio Street, is returned to the Common Council, by the Area Plan Commission, with an unfavorable recommendation. The reason being that the petition is in conflict with the Southeast Neighborhood Rehabilitation Program." The deliberations of the Area Plan Commission and points considered in arriving at the above decision are shown in minutes of that public hearing and will be forwarded to you at a later date to be made a part of this report. RUGE, #414 -75 June 10, 1975 EXISTING ZONING OF SURROUNDING PROPERTY - the areas to the west, south and east are currently zoned "B" Residential. The area to the north is currently zoned "D" Light Industrial. EXISTING LAND USE OF SURROUNDING PROPERTY - the areas to the west, south and east are all either vacant or being used for single family houses. The area to the north has a vacant gas station on it. SITE PLAN - the site plan proposes to build a 58 foot by 44 foot one -story addition to an existing building, being used by Jackson Engineering. The new addition will be used as warehousing and storage of the business inventory. ACCESS_- access to the site will be from Fellows Street through an existing curb cut. No cuts will be constructed on Ohio Street. A second access point would be through the adjacent alley. No State approvals will be required, however, the City Engineer's approval will be necessary. DRAINAGE — storm water runoff must be retained on site per City standards. The City Engineer has noted that the 1,200 gallon dry well shown on the drawing is inadequate and 2,500 gallon additional storage must be shown. PARKING - six parking spaces are shown on the site plan, however the number of employees has not been shown and so a required number cannot be determined. The City Engineer also stated that the parking area must be paved with asphalt or some other acceptable paving material. TABULATED DATA - the size of the site is approximately 13,000 square feet with the building using 42 percent of the lot, the parking and drive areas using another 48 percent and the remaining 10 percent being open space. PRELIMINARY SITE PLAN - because of the questions raised by the City Engineer concerning the site plan and because of several other items that are not shown, the site plan as submitted must be considered a preliminary and any recommendations to the Common Council must be subject to a final site plan. Huron N. and Marjorie D. Ruge (cont °d ; Page 2 AGENCY COMMENTS - as stated above, the City Engineer has raised questions on drainage and the surface of the parking area. He has also stated that some control will be required for access from the alley and he has questioned whether or not sidewalks exist across the front of Lot #9. STAFF COMMENTS- this area has been designated as Light Industry on the Land Use and Trans - portation Plan. The proposed zoning and use of this parcel of land is consistent with this recommendation. In considering the merits of this rezoning, the following should be considered: 1. The use already exists and this is simply an expansion of the business. 2. There are existing commercial and industrial uses to the north of the property on Sample Street. 3. There is a heavily used set of railroad tracks approximately 300 feet west of the site. 4. This rezoning is an expansion of the existing "D" Light Industrial zoning along Sample Street.
