AN ORDINANCE APPROPRIATING $36, 000.00 FROM
THE LOCAL ROADS AND STREETS FUNDS AND
$ 4, 000.00 FROM THE CUMULATIVE CAPITAL
IMPROVEMENT FUNDS TO PROJECT R & S 70 -1975
MIAMI ROAD FROM KERN ROAD TO JACKSON ROAD.
WHEREAS, there was enacted daring the 1969 Session of
the Indiana General Assembly an Act, Chapter 392 of the Acts of 1969,
making available to cities, towns and counties for engineering, construc-
tion or reconstruction of roads, streets and bridges under local juris-
diction, certain additional funds to be derived from the 7th and 8th cents
of Indiana motor fuel tax and fuel use tax and from increases in fees levied
under the Motor Vehicle Act; and
WHEREAS, no appropriation of such funds was included in
the regular 1976 budget for the Civil City of South Bend, Indiana; and
WHEREAS, an emergency exists requiring the appropriation
and expenditure of certain of said funds already received or to be received
before the end of the year 1976 and;
WHEREAS, funds have been appropriated for the City's
matching funds.
NOW, THEREFORE, BE IT ORDAINED by the Common Council
of the City of South Bend, Indiana:
SECTION I. The following sums of money are hereby appropriated
and set apart out of the Local Roads and Streets Fund, and the Cumulative
Capital Improvement Fund for engineering costs on the following project.
R & S 70 -1975 Miami Rd. from Kern Rd. to Jackson Road
Local Rds. and Street Fund
$ 36,000.00
Cumulative Capital Improvement Fund $ 4, 000.00
Total Appropriation
$ 40,000.00
SECTION II. This Ordinance shall be in full force and effect
from and after its passage and approval as required by law.

Dear Council Members:

On June 9, 1975 you approved an appropriation for $55,000 to
cover the preparation of an Environmental Impact Statement (EIS),
field surveys, and design of the construction plans for the above
referenced project. At that time it was explained that this was
only a portion of the possible $95,000 total Preliminary Engineer-
ing fee.
This total fee includes a fixed fee of $80,000 for the survey and
design, and a maximum of $15,000 to cover the cost of the EIS, a
location study, if required, and a Design Study Report; these
last items to be reimbursable on an hourly -rate basis.
The original appropriation was a partial appropriation to insure
the availability of funds to meet cash flow requirements.
In anticipation of the approval of the draft EIS, this final
appropriation for Preliminary Engineering is requested so that
progress may proceed uninterrupted.
