AN ORDINANCE AMENDING ORDINANCE NO. 4990 -68,
AS AMENDED, COMMONLY KNOWN AS THE ZONING
ORDINANCE OF THE CITY OF SOUTH BEND, INDIANA
(Chapter 21, Municipal Code).
BE IT ORDAINED by the Common Council of the City of South Bend,
Indiana:
Section 1. Ordinance No. 4990 -68, as amended, which ordinance
is commonly known as the Zoning Ordinance of the City of South Bend,
Indiana, be and the same hereby is amended in order that the zoning
classification of the following described real estate in the City of South
Bend, St. Joseph County, State of Indiana:
Lots Numbered Forty -six (46) and Forty -seven (47)
in B.F. Dunn's First Addition, a recorded Plat in
the City of South Bend, Indiana
be and the same is hereby established as C -1 Use Classification and
A Height and Area District.
Section 2. This Ordinance shall be in full force and effect from
and after its passage by the Common Council, approval by the Mayor and
legal publication.

The attached rezoning petition of Lynn and Ruth Hoover
was legally advertised April 3, and April 10, 1976. The Area Plan
Commission gave it a public hearing on April 20, 1976, at which
time the following action was taken:
"Upon a motion by Dwight Miller, being seconded by
Paul Klein and unanimously carried, the petition of
Lynn and Ruth Hoover, to zone from "B" Residential, "All
Height and Area, to 11C -111 Commercial, "A" Height and
Area, property located at 2018 and 2022 East Mishawaka
Avenue, City of South Bend, is returned to the Common
Council with a favorable recommendation, subject to a
final site plan, by the Area Plan Commission."
The above recommendation is made subject to a final site
plan, and the preliminary site plan is attached hereto.
The deliberations of the Area Plan Commission and points
considered in arriving at the above decision are shown in minutes
of the public hearing and will be forwarded to you at a later date
to be made a part of this report. Attached for your consideration in
the review of this matter is a copy of the A.P.C. Staff Report.

STAFF REPORT
March 23, 1976
LYNN AND RUTH HOOVER - MISHAWAKA AVENUE #451 -76
LOCATION - southwest corner of Mishawaka Avenue and 21st
Street. Potawatomi Park is directly north of
the site.
EXISTING ZONING OF SURROUNDING PROPERTY - the property to
all four sides of the site is currently zoned "A"
Residential. There is "C" Commercial zoning
approximately 200 feet to the east and "D" Light
Industrial zoning approximately 700 feet to the west.
EXISTING LAND USE OF SURROUNDING PROPERTY - the property to
the north is the Potawatomi Park, the property to
the east is being used for single family houses,
the property to the south is being used for single
family houses and the property to the west is being
used for single family houses and vacant land.
SITE PLAN -the site plan proposes to use the existing houses
for a real estate office, a beauty shop and a real
estate appraisers office. There are two houses, the
one on the corner of 21st Street and Mishawaka Avenue
will be the real estate office. No new buildings
will be constructed, the only addition will be parking
spaces behind the houses.
ACCESS - access plans do not show in detail on the site plan,
however, it would appear that it would be from the
alley behind the houses. No State approvals will
be needed for this site, however, City Engineer's
approval will be required.
DRAINAGE - no drainage plan has been submitted, however, all
storm water must be retained on the property per
City Standards.
PARKING - insufficient data has been provided to determine the
required number of parking spaces. The site plan
indicates 12 spaces would be available and this should
meet the requirements of the Zoning Ordinance.
TABULATED DATA - no tabulated data has been submitted.

PRELIMINARY SITE PLAN - the site plan as submitted does not
have sufficient data to be considered a final.
Therefore, any recommendation by the Area Plan
Commission to the Common Council must be subject
to a final site plan.
AGENCY COMMENTS - Mr. Rollin Farrand, Director, Department of
Public Works, has indicated that public sewer and
water are available to the site. He also indicates
that insufficient information has been submitted to
determine parking requirements. He has also noted
that the parking lot should be redesigned so as to
provide easier access and reduce potential traffic
conflicts in the alley.
STAFF COMMENTS - this area has been designated as Public and
Semi - Public use areas on the Land Use and Transpor-
tation Plan. This designation was used because of
the proposed expansion of the I.U.S.B. campus.
The rezoning and use of the property would not be
in conformance with this recommendation.
ADDITIONAL INFORMATION April 19, 1976
PARKING - the petitioner has stated verbally that there would be
five .(5) employees in the office at 2022 Mishawaka
Avenue and that there will be one beauty operator and
one person in the office at 2018 Mishawaka Avenue.
The twelve parking spaces shown on the site plan
will be sufficient to meet the requirements of the
South Bend Zoning Ordinance.
EXISTING LAND USES - the property to the north is the Potawatomi
Park, the property to the east and south is being used
for single family and multi family houses, and the
property to the west is being used for single family
and multi family houses, office and some vacant land.
