GAMMON Approved and signed by me %q 0?3, 19,74 ORDINANCE NO. 5960 -76 AN ORDINANCE TO APPROPRIATE $112,500.00 FROM THE LOCAL ROAD AND STREET FUND AND $12,500.00 FROM LINE ITEM 260.0 OF THE CUMULATIVE CAPITAL IMPROVEMENT FUND TO PROJECT R & S 48, PHASE III, IRONWOOD ROAD FROM APPROXIMATELY 500' SOUTH OF INWOOD ROAD NORTH TO NORTH OF RIDGEDALE ROAD. WHEREAS, there was enacted during the 1969 session of the Indiana General Assembly an Act, Chapter 392 of the Acts of 1969, making available to cities, towns and counties for engineering, construction or reconstruction of roads, streets and bridges under local jurisdiction, certain additional funds to be derived from the 7th and 8th cents of Indiana Motor Fuel Tax and Fuel -Use Tax, and from increases in fees levied under the Motor Vehicle Act; and WHEREAS, no appropriation of such funds was included in the regular 1976 budget for the Civil City of South Bend, Indiana; and WHEREAS, an emergency exists requiring the appropriation and expendi- ture of certain of said funds already received or to be received before the end of the year; and WHEREAS, funds are to be appropriated for the City's matching share from the Cumulative Capital Improvement Fund. NOW, THEREFORE, BE IT ORDAINED by the Common Council of the City of South Bend, Indiana: SECTION I: The following sums of money are hereby appropriated and ordered set apart out of the Local Road and Street Fund and the Cumulative Capital Improvement Fund for the purpose of right -of -way purchase on the following project: PPn.lFCT Nn- LOCATION R & S 48, Phase III Ironwood Road Local Road & Street Fund Cumulative Capital Improvement Fund TOTAL PROJECT AMOUNT $112,500.00 12,500.00 $125,000.00 SECTION II: This Ordinance shall be in full force and effect from and after its passage and approval as required by law. Director, Public Works Members of the Common Council 441 County /City Building South Bend, IN 46601 Subject: R & S 48 Dear Council Members: Reply To: Department of Public Works February 3, 1976 The Department of Public Works has filed an ordinance requesting appropriation of a total of $125,000 for the purchase of right -of- way for the continued improvement of Ironwood Road. This project extends from the end of the present construction, approximately 1,000 feet north of Ireland Road north to Ewing Avenue. It is the intent of the Department of Public Works to concentrate right -of -way activities in the southern half of this project. Should it prove possible to clear this right -of -way in advance of the north portion of the project, it is anticipated that the total construction project can be subdivided and constructed in stages. The first step that will be undertaken upon approval of this ordinance will be the initiation of appraisals leading to the actual making of an offer for the purchase of properties. The total construction cost for this project is estimated at $800,000, while the construction cost for a portion of the project would depend upon the manner in which it were actually divided in accordance with the available right -of -way. Please note that public hearings on this project have been held. Present traffic demands on this route indicate a need to proceed with the construction of this project. The heavy traffic movements to and from the Scottsdale Mall that move over Ironwood Road to the northern Members of the Common Council Page Two February 3, 1976 part of the City create not only traffic congestion but hazardous con- ditions at the intersection of Ironwood and Ridgedale Roads and Iron- wood and Topsfield Roads. It should also be noted that this project includes storm water retention near the intersection of Ironwood and Ridgedale Roads. This will pro- vide an important secondary benefit through control of drainage on one of the areas contributing to Clyde Creek. Construction of this project north of Ewing Avenue has not been planned or programmed at this time. Work in this area will be coordinated with the recently announced County intention to undertake the design of a railroad grade separation at the Penn Central Railroad tracks. This is a much needed improvement in this area and your favorable con- sideration of this appropriation to initiate this project is recommended. Very truly yours, Rollin E. Farrand, P.E.
