ORDINANCE NO. 3 -?k
AN ORDINANCE TO APPROPRIATE $700,000.00 FROM
THE LOCAL ROADS AND STREETS FUND AND $100,000.00
FROM THE CUMULATIVE SEWER BUILDING AND SINKING
FUND TO PROJECT R & S 85, MAPLE ROAD FROM
LATHROP ROAD TO CLEVELAND ROAD.
WHEREAS, there was enacted during the 1969 session of the Indiana
General Assembly an Act, Chapter 392 of the Acts of 1969, making available
to cities, towns and counties for engineering, construction or reconstruction
of roads, streets and bridges under local jurisdiction, certain additional
funds to be derived from the 7th and 8th cents of Indiana Motor Fuel Tax and
Fuel -Use Tax, and from increases in fees levied under the Motor Vehicle Act;
and
WHEREAS, no appropriation of such funds was included in the regular
1976 budget for the Civil City of South Bend, Indiana; and
WHEREAS, an emergency exists requiring the appropriation and expendi-
ture of certain of said funds already received or to be received before the
end of the year 1976; and
WHEREAS, funds are to be appropriated for the City's matching share
from the Cumulative Sewer Building and Sinking Fund.
NOW, THEREFORE, BE IT ORDAINED by the Common Council of the City of
South Bend, Indiana:
SECTION I: The following sums of money are hereby appropriated
and ordered set apart out of the Local Road and Street Fund and the Cumula-
tive Sewer Building and Sinking Fund for the purpose of widening, reconstruc-
tion and installation of storm drainage.

The Department of Public Works has filed an ordinance requesting a
total appropriation of $800,000 for the construction and right -of-
way purchase for Bendix Drive (Maple Road) from Lathrop to Cleveland
Road, and Cleveland Road for a distance of approximately one mile
west of Bendix Drive.
This work is to be included in a total contract for the development
of Phase IV of the Airport Industrial Park. This total contract will
be advertised and awarded by the Board of Public Works of the City of
South Bend. This work constitutes the City's share of the required
match for EDA Funds, and is necessary to complete the project.
The total project costs are estimated to be approximately $1,860,000.
The additional matching funds required to provide fifty per cent of
the project costs are provided by the Toll Road separation structure
now being constructed by St. Joseph County.
In addition to serving the Industrial Park, this improvement will serve
and benefit other commercial land along Bendix Drive and north of Cleve-
land Road. This improvement will relieve the congestion now occurring
on Bendix Drive during peak -hour traffic conditions.
