AN ORDINANCE AMENDING AND SUPPLEMENTING
ORDINANCE NO. 4990 -68, CHAPTER 21 OF THE MUNICIPAL CODE
OF THE CITY OF SOUTH BEND, INDIANA, FORMERLY REFERRED
TO AS ZONING ORDINANCE NO.3702
BE IT ORDAINED BY THE COMMON COUNCIL OF THE CITY OF SOUTH BEND,
INDIANA:
Section 1.
That Zoning Ordinance No. 4990 -68, Chapter 21 of the
Municipal Code of the City of South Bend, Indiana, formerly known
as Zoning Ordinance No. 3702, be and the same is hereby amended
and supplemented by changing the zoning classification of the
following described property from "A" Residence District to "B"
Residence District:
"Lots 3,4,5,6,7 and 8, as shown on the recorded Plat of
Tuxedo Park First Addition to South Bend, St. Joseph County,
Indiana, together with the strip of land 35 feet in width,
more or less, running along the entire East side of said
Lot 8 from the North line of Jefferson Boulevard North to
the South line of Marshall Street, being the same and
identical strip of land which was formerly known as 26th
Street and which was heretofore vacated as a public Street,
by action of the Board of Public Works and Safety under
Vacation Resolution Number 2824, in St.Joseph County,Indiana."
Section 2.
This Ordinance shall be in full force and effect from and
after its enactment, approval by the Mayor and legal publication.

of the City of South Bend, Indiana, formerly referred
to as Zoning Ordinance No. 3702 (2515 East Jefferson
Boulevard).

2. D. SOUTH BEND OSTEOPATHIC HOSPITAL #431 -75
LOCATION - north side of Jefferson Boulevard to Marshall
Street, between Tuxedo Drive and 26th Street.
EXISTING ZONING -- SURROUNDING PROPERTY - the property to
the west, north and east is all currently zoned
"A" Residential. The property to the south is
currently zoned "B" Residential.
EXISTING LAND USE -- SURROUNDING PROPERTY - the property to
the west and north is currently being used for
single family houses, the property to the east is
being used for multi - family dwelling units and the
property to the south is being used for multi - family
dwelling units and for St. Anthony's Church and school.
SITE PLAN -the site plan proposes to construct an addition of
63,600 feet to be used for new hospital facilitiev
and new doctors offices. The new facility will not
add to the number of beds in the hospital, but will
be used to house new equipment.
ACCESS - access to the site will be through three points,
two on Jefferson Boulevard and one on Marshall St,::eet.
State approval will not be required, however, the
City Engineer must issue permits for the new drives.
DRAINAGE - the drainage plan, as submitted, meets the City
standards, and has been approved by the City Engineer.
PARKING - all parking requirements, as shown in the South
Bend Zoning Ordinance, have been met.
TABULATED DATA - the site is approximately 210,000 square feet
with the existing and proposed buildings taking approxi
mately 39,400 square feet, the drives and parking
areas taking approximately 107,300 square feet and
the remaining land being left in open space.
FINAL SITE PLAN - the site plan, as submitted, does have
sufficient data to be considered a final site plan.
AGENCY COMMENTS - Mr. Rollin Farrand, Director, Department of
Public works, has indicated that utilities are
available to the site and that the storm drainage
is correct as shown. He has also indicated three
small problems with the site plan. The petitioners
have been contacted concerning these problems and
they are in the process of correcting them.

STAFF COMMENTS - this area has been designated as
Residential, Low Density on the Land Use and
Transportation Plan. The proposed zoning and
use of this land would be compatible with this plan.

In Re: A proposed ordinance and site development plan of
the South Bend Osteopathic Hospital, Inc. (Dr. Walter
W. Landis, Chairman) to zone from "A" Residential, "A"
Height and Area, to "B" Residential, "A" Height and
Area, property located on the north side of Jefferson
Boulevard, east of Tuxedo Drive, City of South Bend
Gentlemen:
The attached rezoning petition of the South Bend
Osteopathic Hospital, Inc. (Dr. Walter W. Landis, Chairman)
was legally advertised November 8, and November 15, 1975. The
Area Plan Commission gave it a public hearing on November 18,
1975, at which time the following action was taken:
"Upon a motion by Robert Lehman, being seconded by

Walter W. Landis, Chairman) to zone from "A" Residential,
"A" Height and Area, to "B" Residential, "A" Height and

Boulevard, east of Tuxedo Drive, City of South Bend,
Irene Gammon is returned to the Common Council with a favorable
recommendation, subject to a final site plan, by the
CITY CLERK, SOUTH BEND, IND. Area Plan Commission."
The above recommendation is made subject to a final site
plan and the preliminary site plan is attached hereto.
The deliberations of the Area Plan Commission and points
considered in arriving at the above decision are shown in minutes
of the public hearing and will be forwarded to you at a later date
to be made a part of this report. Attached for your considera-
tion in the review of this matter is the Area Plan Staff Report.
