AN ORDINANCE APPROPRIATING $40,000 FROM THE COMMUNITY DEVELOPMENT FUND, FOR NON- PROFIT HOUSING REHABILITATION PROGRAM, TO BE ADMINISTERED BY THE CITY OF SOUTH BEND THROUGH ITS BUREAU OF HOUSING. WHEREAS, the Department of Human Resources in the name of the City of South Bend has received the approval of the United States Department of Housing and Urban Development to execute certain community development project activities to preserve and rehabilitate the existing City's housing stock. NOW, THEREFORE, BE IT ORDAINED by the Common Council of the City of South Bend as follows: Section I. The sum of $40,000 is hereby appropriated for the program year starting July 7, 1976, from the South Bend Community Development Block Grant Program. This appropriation is to be administered by the Bureau of Housing. This ordinance shall be in full force and effect from and after its passage by the Common Council and approval by the Mayor. r"the ommon C�ou cil d only to provi o ^it r ' -c scussion ` ncil action on the issue COMMUNITY DEVELOPMENT Housing Rehabilitation Assistance Program Non - Profit Group Rehabilitation Bonafide non - profit groups with an interest in improving neighborhood housing conditions are encouraged to apply for grants under the Community Development Housing Rehabilitation Assistance Plan. All non - profit groups must provide a copy of their charter under the State of Indiana identifying them as a non - profit group. Application A designated representative of the non - profit group shall apply for a rehabilitation grant under the Housing Assistanc e Program through the Bureau of Housing. An individual application must be made for each house the group wishes to rehabilitate and be directed to the Bureau of Housing in writing. The letter shall specify the dwelling unit address, the time available for inspection, and the group representative to be contacted for access to the unit. All units must be located with the Housing Assistance Plan Area (see Exhibit A) but not located within the approved Historic District of South Bend (See Exhibit A -1). Inspection Upon receipt of the application an inspection appointment shall be arranged with the group representative. The representative shall accompany the inspector throughout the inspection of the unit and shall point out those items over and above the major code violations that are to be corrected. The inspector shall prepare a specification write -up and submit it to the cost estimator for processing. The completed specification is then presented to the Project Director and the Chief Inspector for review and approval. Grant Qualification Processing The approved specifications are submitted to the Project Advisory Board for referral to theRedevelopment Commission. The cash grant shall be based on the estimated cost of repairs including labor. Part or all of the cash grant may be used to purchase the unit but the non - profit group must demonstrate its ability to rehabilitate the unit without additional grant assistance. In no instance shall the cash grant be used to purchase real property. The maximum grant amount available for any one home is $5,000. Provided all criteria have been met, the Redevelopment Commission shall approve the application, sign the Contract Agreement, and disburse the cash grant amount as follows: 1. An account shall be opened in a commercial bank in the joint name of the Bureau of Housing of the City of South Bend and the non - profit group. 2. The amount of the grant shall be deposited in the account for each house approved for rehabilitation by the Redevelop- ment Commission. Contract Procedure All work must be completed within a reasonable period of time. After each stage of rehabilitation, an inspection shall be made by the staff inspectors to determine whether the work is satisfactory or not. Money for further work may be withheld until previous work has been approved. Once rehabilitation has been completed and has received a final inspection a final payment of the remainder of the grant account shall be paid to the non - profit group. Money remain- ing in the account after final inspection shall belong to the non- profit group, for further housing rehabilitating. Through this ordinance, non - profit groups who have demonstrated a desire to rehabilitate residential structures are able to receive funding.
