BE IT ORDAINED by the Common Council of the City of South Bend, Indiana: Section 1. Ordinance No. 4990 -68, as amended, which ordinance is commonly known as the Zoning Ordinance of the City of South Bend, Indiana, be and the same hereby is amended in order that the zoning classification of the following described real estate in the City of South Bend, St. Joseph County, State of Indiana: Lots numbered 7, 8, 9, 10, 11, 12, 13, 14, 15, 16, 17, 18, 19, and 20, all as shown on the Recorded Plat of Morris Park Addition to the City of South Bend, recorded June 21, 1906, in Plat Book 9, Page 40, in the Office of the Recorder of St. Joseph County, Indiana, be and the same is hereby established as "C -1" Commercial Use District and "A" Height and Area District. Section 2. I (We), the undersigned, do hereby respectfully make application and petition the Common Council of the City of South Bend to amend the Zoning Ordinance of the City of South Bend, Indiana as hereinafter requested, and in support of this application, the following facts are shown: 1. The property sought to be rezoned is located at the square block bounded by Portage Avenue, Kinyon Street, Anderson Avenue, and Bulla Street, in the City of South Bend, Indiana. 2. The property is owned by LaSalle, Inc., an Indiana corporation which is an affiliate of The National Bank and Trust Company of South Bend, a national banking association. 3. JOHNSON Executive Director South Bend, Indiana 46601 (219) 284 -9571 July 21, 1976 In Re: A proposed ordinance and site development plan of LaSalle, Inc., an Indiana Corporation, which is an affiliate of The National Bank and Trust Company of South Bend, to zone from "B" and "A" Residential, "A" Height and Area, to "C -1" Commercial, "A" Height and Area, property located at the square block bounded by Portage Avenue, Kinyon Street, Anderson Avenue, and Bulla Street, City of South Bend Gentlemen: The attached rezoning petition of LaSalle, Inc. was legally advertised July 10, 1976. The Area Plan Commission gave it a public hearing on July 20, 1976, at which time the following action was taken: "Upon a motion by Joseph Serge, being seconded by Daniel Chrzan and unanimously carried, the petition of LaSalle, Inc., an Indiana Corporation, which is an affiliate of The National Bank and Trust Company of South Bend, to zone from "B" and "A" Residential, "A" Height and Area, to "C -1" Commercial, "A" Height and Area, property located at the square block bounded by Portage Avenue, Kinyon Street, Anderson Avenue, and Bulla Street, City of South Bend, is returned to the City Council with a favorable recommendation, subject to a final site plan with the following conditions: the modification of the access system which removes a curb cut from Anderson Street and relocates the curb cut on Kinyon Street; the vacation of the alley which is currently upon the site; provision of landscape screening along Anderson Street. The Commission further encouraged the developer to preserve as many mature trees upon the site as is possible." The above recommendation is made subject to a final site plan, and the preliminary site plan is attached hereto. STAFF REPORT NATIONAL BANK & TRUST CO.<: #465 =76; June 25, 1976 LOCATION - on the west side of Portage Avenue between Bulla and Kinyon Streets. (This project is approximately two blocks north of Elwood Street and the Martin's Store.) EXISTING ZONING OF THE SURROUNDING PROPERTY - the property to the north and east is currently zoned "B" Residential. The property to the south is zoned "A" Residential, "B" Residential and "C" Commercial, and the property to the west is zoned "A" Residential. EXISTING LAND USE OF THE SURROUNDING PROPERTY - the property to the north is currently being used for single family houses with one vacant lot at the corner of Kinyon Street and Portage Avenue. The property to the east is being used for single family houses and a South Bend Fire Station. The property to the south is currently being used for commercial purposes and there are some multi - family uses, and the property to the west is being used for single family houses. SITE PLAN -the site plan proposes the construction of a single story branch bank facility for the National Bank & Trust Co. The bank will have drive -up facilities and parking spaces for customers. No other uses are proposed for the site. ACCESS - access to the site will be from four points, one drive from each of the four streets that surround the site. The site plan layout as submitted would appear to allow most of the exiting traffic to use the existing residential streets and the Staff feels that this must be corrected prior to final site plan submittal. DRAINAGE - the site plan also indicates that all storm water will be retained on the site through a system of dry wells. A detailed drainage plan must be approved by the City Engineer prior to final site plan submittal. PARKING - the site plan indicates that 52 parking spaces will be provided on the site. This will meet the requirements of the South Bend Zoning Ordinance.
