AN ORDINANCE TO APPROPRIATE $ 8,100.00 FROM
THE LOCAL ROAD AND STREET FUND AND $ 900.00
FROM THE CUMULATIVE CAPITAL IMPROVEMENT FUNDS TO
PROJECT RFC S 72, CONSTRUCTION OF DON40YER AVENUE
FROM MAIN STREET TO MICHIGAN STREET
WHEREAS, there was enacted during the 1969 Session of the Indiana
General Assembly an Act, Chapter 392 of the Acts of 1969, making available
to cities, towns and counties for engineering, construction or reconstruction
of roads, streets and bridges under local jurisdiction, certain additional
funds to be derived from the 7th and 8th cents of Indiana, motor fuel tax and
fuel tax and from increases in fees levied under the Motor Vehicle Act;
and
WHEREAS, no appropriation of such funds was included in the regular 1976
budget for the Civil City of South Bend, Indiana; and
WHEREAS, an emergency exists requiring the appropriation and expenditure
of certain of said funds already received or to be received before the end of the
year 1976; and
WHEREAS, funds have been appropriated for the City's matching funds.
NOW, THEREFORE, BE IT ORDAINED by the Common Council of the City of South
Bend, Indiana:
SECTION I. The following sums of money are hereby appropriated and
ordered set apart out of the Local Roads and Street Fund, and the Cumulative
Capital Improvement Fund for additional Right -of -way $ Construction

SECTION II. This Ordinance shall be in full force and effect from

By letter dated September 5, 1975, the Indiana Arterial Road and
Street Board notified the City of their approval of $38,700 in
LRSA Funds for the above referenced project. This money is
matched by an appropriation of $4,300 from the Cumulative Capital
Improvement Fund for a total of $43,000.
Public bids have been advertised, accepted, and a contract for the
project awarded to Rieth -Riley Construction Company in the amount
of $31,558.25. Total right -of -way acquisition costs have been
incurred in the amount of $16,643.46, including a condemnation
amount of $12,500. The additional amount requested herein is
necessary to provide sufficient funds for the right -of -way acquisi-
tion and construction of this project.
The Engineer's estimate on this project appears to have been reason-
ably accurate, but the amount of the condemnation award exceeded our
estimate.
