They include: • Preparation of documents to IDEM including a Comment letter responding to IDEM's 87 comments on our proposed Remediation Work Plan, a Sampling and Analysis Plan, an updated Health and Safety Plan, and an updated Quality Assurance Project Plan. • Additional soil sampling in three areas where IDEM asked for additional sampling. • Installation of temporary and permanent groundwater sampling points within the Oliver Industrial Park as well as upgradient and downgradient of the site. The purpose of the additional groundwater sampling will be to determine the extent (both vertically and horizontally) of chemicals of concern in the groundwater. • Quarterly groundwater sampling and monitoring for eight quarters. • Evaluate groundwater sampling results and determine remedies for treating the groundwater. • Restrict groundwater usage through establishment of an Administrative Control Area through the St. Joseph County Health Department. • Use the results of the soil and groundwater sampling to prepare an amended Remediation Work Plan to be submitted to IDEM. The schedule for this work is to have the sampling completed by the end of November and the Amended Remediation Work Plan submitted to IDEM by the end of December. Quarterly groundwater monitoring would not begin until 2014. The total cost of this contract $194,283. This work has been anticipated for some time. Our Remediation Work Plan was submitted to IDEM in 2011 but we did not receive comments from them until May of this year. We 227 W. JEFFERSON BLVD. Dear Ms. Kolata: Hull & Associates, Inc. (Hull) is pleased to present the City of South Bend (Client) the following proposal to provide professional engineering services for the above - referenced project. The purpose of this document is to establish the Scope of Work as we understand it and to provide a fee schedule for the project. This proposal presents Hull & Associates, Inc.'s (Hull's) recommendations for additional tasks needed to conduct additional assessment activities and prepare an amended Indiana Voluntary Remediation Program (VRP) Remediation Work Plan (RWP) for the three vacant parcels of the Oliver Industrial Park (the Site) and additional off -site properties. Site Physical Setting and Background The Site is located approximately one mile southwest of downtown South Bend. From 1876 to 1989, activities at the Site included the manufacture of farm machinery and implements. The Site consists of several vacant lots and commercial /light industrial businesses, and is bordered by commercial /industrial properties to the southwest, south, and east of the Site; and an active rail line along the northern boundary of the Site. Residential properties are located across the western and northern boundaries of the Site. The Site is comprised of three vacant parcels totaling approximately 14.45 acres ( + / -) of land located near the intersection of Chapin Street and Oliver Plow Court in South Bend, Indiana. The Site formerly comprised approximately 36 acres of land, but the City and private entities have redeveloped portions of the Oliver Industrial Park, effectively removing certain parcels of the Site from inclusion in the VRP. Multiple environmental assessments have been conducted at the Site. Soil sampling completed thus far has revealed that benzo(a)pyrene, dibenz(a,h)anthrocene, tetrachloroethene, and TPH (historically detected in one location by obsolete method 418.1) are the only chemicals of concern (COCs) in soils that exceed their respective VRP Tier II Nonresidential Cleanup Goals. Extensive on- and off -Site groundwater testing completed thus far has revealed that tetrachloroethene (PCE), trichloroethene (TCE), and vinyl chloride (VC) are the only COCs in groundwater that exceed their respective VRP Tier II Nonresidential Cleanup Goals or the Indiana Department of Environmental Management's (IDEM's) 2012 Remediation Closure Guide (RCG) Commercial and /or Residential Groundwater Screening Levels. In December 2011, Hull submitted a RWP for the Site that presented a general path forward for additional assessment and remediation pursuant to VRP requirements. In May 2013, IDEM responded with comments to the RWP. The City and Hull responded to IDEM's comments in a letter dated August 1, 2013. That August 1, 2013 letter outlined additional assessment activities that would be initiated by the City, and proposed an 8470 Allison Pointe Boulevard, Suite 120, Indianapolis, Indiana 46250 800.241.7173 614.793.9070 fax www.hullinc.com Ms. Ann Kolato SBI070.400.0002 October 15, 2013 Page 2 approximate deadline for submitting an amended RWP of December 20, 2013. Finally, Hull submitted a letter to the City on August 30, 2013 that outlined additional likely steps forward to further assess and remediate the Site pursuant to the VRP. Given the current status of the Site, the following additional activities are proposed: Task 1 Prepare Various IDEM VRP Documents A Sampling and Analysis Plan (SAP) detailing the locations, sampling methods, and laboratory analyses proposed for the next stages of on- and off -Site soil and groundwater sampling must be prepared and approved by IDEM. The SAP will explain field activities that will be completed in Tasks 2 through 4 immediately below. IDEM has also requested that an updated Health and Safety Plan (HASP) and Quality Assurance Project Plan (QAPP) be submitted for their review and approval. Hull proposes to submit revised versions of the existing SAP and existing QAPP first for IDEM's consideration, then follow with an updated HASP prior to the initiation of field activities. Also, as indicated above, Hull has already prepared the August 1, 2013 letter responding to IDEM's 87 individual comments to the RWP, compiled certain historical laboratory data not previously provided to IDEM, and prepared the additional likely steps forward letter as requested by the City. The effort for this correspondence was not covered under the scope of a previous proposal; therefore charges for preparing these letters, including time to discuss response strategy and draft letters with the City and its outside counsel, are included under this Task. Task 2 Install and Sample On -Site Soil Borings This Task will begin with a Site visit to evaluate the presence and condition of all on- and off -site monitoring wells, as well as to mark boring locations before public utility locators are contacted. As requested by IDEM, and as proposed in Hull's August 1, 2013 letter, additional soil sampling must be completed in the southwest parcel of the Site (near Area 19 where a quench oil pit associated with a heat treatment line in former Building 47, and near Area 21 where discolored soils were encountered during demolition activities), and in the southeast parcel of the Site within the footprint of the former Oliver foundry. Ten soil borings within the former Oliver foundry (to depths of 10' below ground surface (bgs)), five soil borings within the former Oliver foundry (to depths of 25' bgs), three soil borings within Area 19 (to depths of 20' bgs), and one soil boring near Area 21 (to a depth of 20' bgs), are proposed. Costs for this Task include analysis of one surface sample and, as applicable, one subsurface soil sample per soil boring - collected using a direct -push drilling rig — and to be tested for: • up to 23 samples collected at 19 soil borings, including quality assurance /quality control (QA /QC) samples, for Resource Conservation and Recovery Act metals using Method SW 846 6010/7000; • up to eight (8) samples collected at three (3) soil borings, including QA /QC samples, for VOCs using Indiana Modified Method 5035A; • up to 22 samples collected at 18 soil borings, including QA /QC samples, for SVOCs using Method SW846 8270/8270 SIM; and • up to seven (7) samples collected at three (3) soil borings, including QA /QC samples, for PCBs using Method SW846 8081. Soil sampling will be conducted using a direct -push unit. Hull's field representative will screen samples using a photoionization detector (PID). The driller will be required to decontaminate all down -hole equipment between Ms. Ann Kolata SBI070.400.0002 October 15, 2013 Page 3 sampling depths using a non - phosphatic detergent (e.g., Liquinox) and rinsing with distilled water. Soil samples will be selected based on Hull's field observations. In general, those samples exhibiting the highest PID readings or other evidence of impact will be selected for chemical analysis. In addition, a second (deeper) soil sample may be selected and submitted to the laboratory to evaluate the vertical extent of contamination. If samples in a given boring exhibit little variation in the degree of apparent contamination, Hull's field representative may preferentially select the surface sample (i.e. 0 to 2 ft. bgs) for analysis. Unused samples will be placed in a Department of Transportation- approved 55- gallon drum. The driller will decommission the borings by filling the boreholes with bentonite chips. Note that because Hull's drilling subcontractor will likely issue a single invoice for the soil borings and the temporary groundwater sampling points, subcontractor costs for the soil boring installation are included in Task 3 for purposes of this cost estimate. Task 3 Install Temporary and Permanent GW Sampling Points Additional on -Site groundwater sampling to evaluate the potential impact from COCs associated with the former Oliver foundry is required. As presented in the December 2011 RWP, a limited number of groundwater samples within the footprint of the former foundry have been proposed, and IDEM agrees with this approach. Also, as we have discussed, an evaluation of the extent to which off -Site sources may have impacted groundwater underlying the Site is necessary. The installation and sampling of a series of temporary groundwater monitoring points within City right -of -way along Arnold Street south and west of the Site (i.e., across the upgradient section of groundwater entering the Site's southwest parcel) will aid in evaluating where off -Site sources may be contributing to the groundwater impacts that have been observed at the Site. Based on the results of the temporary sampling completed in this Task, additional permanent groundwater monitoring wells may be needed within City right -of -way along Arnold Street, as described below. Also, as requested by IDEM, and as proposed in Hull's August 1, 2013 letter, four monitoring wells are necessary north (i.e., downgrodient) of the Site at locations that will be acceptable to the City, property owners of the Kroc Center, and property owners of the Laurel Place Apartments. Following the installation of these newer monitoring wells, the top of casing and ground elevations of the new wells, as well as the elevations of PMW- 11, MW -135, and MW -14S [which were cut down during construction of the Underground Pipe & Valve (UP &V) facility], will be surveyed so that the groundwater elevations measured in these wells can be compared relative to the other wells in the monitoring network. Hull will install the initial temporary groundwater sampling points within the right -of -way of Arnold Street, between Poland Street and West Sample Street, as discussed below. Please note these sampling locations have been selected to evaluate the potential presence of an upgradient source of the impacts detected in MW -1, which is the most upgradient groundwater sampling point at the Site, and is also where the highest groundwater impacts at the Site have been historically detected. Hull will also install temporary groundwater sampling points within the footprint of the former Oliver foundry during the some mobilization. In general, our proposed approach entails defining the vertical extent of chlorinated volatile organic compounds (VOCs) upgradient of MW -1 by installing four relatively shallow and four relatively deeper temporary sampling points (installed at four nested sampling locations) within the right -of -way of Arnold Street; installing permanent monitoring wells north of the Site while laboratory analyses on the samples from the temporary points are completed; and installing three permanent sets of nested monitoring wells upgradient of MW -1 (again, within the right -of -way of Arnold Street) at appropriate locations once the vertical extent is Ms. Ann Kolata SBI070.400.0002 October 15, 2013 Page 4 defined. This task will begin with the advancement of temporary screens using direct -push technologies (e.g., a ST -15 Hydropunch) to a shallow depth (i.e., 26 to 30 feet below ground surface (bgs)) and a deeper depth of approximately 36 to 40 feet bgs at each of four (4) locations, subject to approval of these locations from the Client's Board of Public Works (BPW). The locations may be adjusted slightly in the field based on field observations such as utility locations, etc. Hull will work with the drilling subcontractor and the appropriate City and St. Joseph County authorities to arrange for access for the work and to clear utilities and to prepare appropriate permits for drilling in the right -of -way. Adjacent property owners will be notified by certified mail prior to the initiation of any drilling activities. Drill cuttings and sample purge and decontamination water will be containerized and placed at a location designated by the City. At each location where groundwater sampling is to be conducted, the borehole will initially be advanced to the deeper depth (i.e., between approximately 36 and 40 feet bgs), at which point the outer casing of the sampling system will be withdrawn to expose a four foot long stainless steel wire wrapped screen. Once the screen is exposed, Hull will measure the static water level and lower a decontaminated Waterro foot -valve sampling pump or peristaltic pump to purge the equivalent of five well volumes of water to develop the aquifer surrounding the screen. Following extraction of each well volume, Hull will measure pH, temperature and conductivity to demonstrate that representative groundwater is being sampled. In addition, Hull's representative will note if there is a visible sheen on the extracted water. After development, the temporary well will be allowed rest for approximately 20 minutes prior to sample collection. Following purging, Hull will collect groundwater samples that will be pumped through the Waterra or bladder pump tubing at a flow rate of less than 100 ml /min. Samples will be transferred directly into laboratory - preserved sample containers and placed on ice in a cooler. Following collection of each sample, Hull will retrieve and decontaminate the Waterra foot -valve pump by washing it with Alconox and water and rinsing it with deionized water. In addition, the sample tubing will be replaced between each sampling interval. The groundwater sample in the upper portion of the aquifer (i.e., between approximately 26 and 30 feet bgs) will be collected by withdrawing the screen to the appropriate depth and purging and collecting a groundwater sample as described above. The process for purging and collecting the relatively shallower groundwater sample will then be completed as described above. Between each of the sampling locations, the drilling rods and well screen will be decontaminated by washing with Alconox and water solution and rinsing with deionized water. Up to 13 groundwater samples (two samples at variable depths per borehole in the Arnold Street borings, plus one sample collected from approximately 25' bgs within the footprint of the former Oliver foundry) plus seven QA /QC samples, collected from the temporary boreholes using direct -push technologies, will be analyzed for VOCs. Two field blanks and two trip blanks will also be analyzed for VOCs. Results for the laboratory analyses will be requested to be reported by the laboratory within five business days. Pending laboratory results from the temporary sampling points, four deep and shallow nested monitoring wells will be installed off -Site in the vicinity of the Kroc Center and the Laurel Place Apartments (preferably within City right -of -way), to further evaluate the downgradient distribution of VOCs north of the Site. Following the receipt of laboratory results on the temporary sampling locations, up to three deep and shallow nested monitoring wells will be installed within the right -of -way of Arnold Street at locations approved by the City. Ms. Ann Kolata 561070.400.0002 October 15, 2013 Page 5 This estimate includes costs to install one additional deep and shallow nested monitoring well location if needed based on the results of the soil sampling in Task 2 above (e.g., within the former Oliver foundry parcel). Soil borings associated with the proposed monitoring wells will be drilled using 4.25 -in., inside - diameter hollow - stem augers and continuously sampled using 24 -in. split -spoon samplers to the appropriate depth (i.e., either 30 feet bgs or 45 feet bgs). Similar to the locations of the direct -push sampling points, the final locations of the monitoring wells may be modified based on field observations. Although the deeper boring at each location will be continuously sampled, soil samples are not proposed to be submitted for laboratory analyses as part of the monitoring well installation. Monitoring wells will be constructed of Schedule 40 PVC slotted screens and risers. Once the targeted depth has been reached, the well column will be slowly lowered to the base of the borehole. A clean silica quartz sand filter pack will be placed around the screen and will extend no more than two feet above the top of the screen. Sodium bentonite chips or pellets will then be placed on top of the sand pack. Above the chips or pellets, a thick bentonite slurry will be pumped into the annular space using a tremie pipe to a depth of approximately three feet below ground surface. The remaining three feet will be filled with concrete to anchor a flush -mount manhole. Monitoring wells will be developed following installation to remove fines that may have entered the well screen or filter pack during installation. Well development activities will continue until pH, temperature, and conductivity have stabilized for three consecutive well volumes, or until five well volumes have been removed, whichever is greater. Development waters will be collected and stored in a DOT approved 55- gallon drum. Costs to remove, transport, and dispose of approximately 51 55- gallon drums of containerized groundwater and drill cuttings (which are presumed to be non - hazardous) are included in this task. Task 4 Conduct Quarterly Groundwater Monitoring Following the installation of new monitoring wells, a routine of quarterly groundwater sample collection from all monitoring wells is proposed. This will establish a baseline and, after several quarters, will begin to allow for seasonal trend analysis. After four to six quarters, a sufficient trend should be established to allow for an analysis of whether certain monitoring wells can be removed from the quarterly sampling routine, with IDEM concurrence. In the meantime, however, this estimate assumes that quarterly groundwater samples will be collected from all existing and newly - installed monitoring wells on- and off -Site (an estimated total of 51 monitoring wells) for 8 quarters. Groundwater samples will be collected from all newly installed monitoring wells and submitted to the laboratory for VOC analysis using U.S. EPA Method 8260. Duplicate samples will be collected at randomly selected monitoring well locations. Field /equipment blanks will also be collected and submitted along with a trip blank for analysis as part of QA /QC of field procedures. Purge and decontamination waters will be collected and stored in U.S. DOT - approved 55- gallon drums. Costs to remove, transport, and dispose of eight 55- gallon drums of containerized groundwater and drill cuttings (which are presumed to be non- hazardous) are included in this task. For the proposed sampling events, in lieu of traditional low -flow sampling methods that have been employed at the Site previously, Hull proposes to deploy passive diffusion bag (PDB) samplers in all monitoring wells, which are a significantly more cost- effective sampling methodology that has been accepted by IDEM. PDBs Ms. Ann Kolata 561070.400.0002 October 15, 2013 Page b are polyethylene bogs filled with analyte -free water that are hung in monitoring wells for approximately 14 days. Field personnel return to the monitoring well, retrieve the sampler, and collect the sample by filling sampling vials in the same manner as traditional methods. Significant savings are realized by reducing mobilization, purging, and sampling time; by minimizing the volume (and thereby cost and environmental footprint) of field materials such as low -flow tubing; and by eliminating most equipment rental costs. Laboratory analytical subcontractor costs for this Task include the cost of PDBs for each well, and for Level IV QA /QC reporting by the laboratory. This estimate assumes that the City and Hull will succeed in gaining IDEM approval to cease sampling groundwater for lead and arsenic, which should be acceptable given the proposed restriction of groundwater use as discussed in Task 5 below. A brief draft letter report documenting the results of each quarterly sampling event will be prepared and submitted to the Client for review. Once the draft letter report is reviewed by the Client and finalized by Hull, a copy will be submitted to the IDEM VRP. Task 5 Evaluate GW Remedies, Restrict GW Use. and Amend the RWP Once the extent of downgradient groundwater impacts, the current status of groundwater impacts on -Site, and the potential off -Site [i.e., south and southwest (upgradient)] sources that may be contributing to groundwater entering the Site's southern boundary are better understood by the activities to be completed in steps 2, 3, and 4 above, the prior remedy (i.e., EOSTM) that was pilot tested — and shown to be effective — will be re- evaluated for additional applications. At present, we presume that it will remain the preferred option, but as the groundwater in -situ treatment technology market has evolved in the last 3 -4 years, we will commit to evaluating similar chemistries that may offer a cost and /or effectiveness advantage. As we have discussed previously, Hull recommends that the City effectively render incomplete the groundwater ingestion exposure pathway at and in the vicinity of the Site by ensuring that St. Joseph County Code 52, Section 52.042 is enforced, which prohibits the installation of wells for potable use where a municipal water source is available, and Section 52.043 is implemented for the vicinity of the Site, which governs the establishment of an Administrative Control Area (ACA). The language of Section 52.043, whereby an ACA is established, contains additional relatively far- reaching yet flexible provisions to further restrict exposure to groundwater when a threat to human health may be present. Hull and the City's outside counsel have already engaged the St. Joseph County Health Department to begin the process of establishing an ACA, and will continue to pursue this effort. We are confident that once the ACA is established, the groundwater ingestion exposure pathway will officially be rendered incomplete, thereby eliminating the need to sample groundwater on- and off -Site for lead and arsenic concentrations. The results of the additional soil sampling in Task 1 above, the evaluation of the proposed groundwater remedy, the extent to which a future remedy is necessary based on the additional groundwater delineation and monitoring, and the progress of establishing the ACA will be summarized in an amendment to the December 2011 RWP. A draft of the forthcoming amended RWP will be provided to the City and its outside counsel prior to finalization and submittal to IDEM. SCHEDULE Hull can begin coordinating soil and groundwater sampling immediately, subject to your approval of this proposal. Assuming our drilling subcontractor remains reasonably available, we anticipate all drilling and sampling activities will be completed by the end of November 2013, and that the Amended RWP can be Ms. Ann Kolata SB1070.A00.0002 October 15, 2013 Page 7 completed by the end of December 2013. COMPENSATION A breakdown of costs is attached as Table 1. The fees have been developed based on our estimate of hours for each labor category expected to be involved in the project. The project will be billed on a four -week basis with payment due to Hull within thirty days after receipt of an invoice. ADDITIONAL WORK Additional work beyond the Scope of Work defined herein shall not be performed until such time as an amendment to this proposal, including the scope of the additional work and associated costs, has been prepared in writing to address the additional work and said amendment has been approved by the Client in writing. Specific items not within the Scope of Work on this project include, but are not limited to the following 1 . collection of more than 65 groundwater samples (including QA /QC samples) to be analyzed for VOCs in accordance with U.S. EPA Method 8260 per quarterly sampling event; 2. collection and analysis of more than 23 soil samples, including QA /QC samples, for chemical analysis; 3. disposal of groundwater or soil that is determined to be hazardous; and A. communication with regulatory agencies regarding the Site. No amendment to this proposal shall be required in situations where additional work may be necessary, as a result of unanticipated or unidentified conditions including, but not limited to, the presence of unidentified or mislocated buried utilities, structures, or objects and unanticipated hazardous materials and /or hazardous or dangerous circumstances, to complete previously identified tasks. Hull shall be compensated for the actual time spent performing this additional work and other direct expenses and subcontractor fees at the billing rates outlined in Table 2. STANDARD OF CARE AND LIMITATIONS Hull shall perform its services using that degree of care and skill ordinarily exercised under similar conditions by reputable members of its profession practicing in the some or similar locality at the time of service. No other warranty, expressed or implied, is made or intended by our proposal or by our oral or written reports. The work will not attempt to evaluate past or present compliance with federal, state, or local environmental or land use laws or regulations. Conclusions presented by Hull regarding the Site to be investigated shall be consistent with the Scope of Work, level of effort specified, and investigative techniques employed. Reports, opinions, letters, and other documents will not evaluate the presence or absence of any compound or parameter not specifically analyzed and reported. The presence of radiation, radon, lead, electromagnetic fields, and indoor air pollution will not be investigated, unless specifically stated in the scope of work. Hull makes no guarantees regarding the completeness or accuracy of any information obtained from public or private files or information provided by subcontractors. Hourly billing rates for personnel apply to actual time spent in meetings concerning the project, preparing for such meetings, project coordination time, design activities, field and office investigations, and travel time when job - related. 2. If personal vehicles are utilized, travel mileage is billed at the federal mileage reimbursement rate. If company-owned vehicles are utilized, rental rates of $75 /day, $300/week, or $1,000 /month are used in lieu of travel mileage. If rental vehicles are utilized, the actual cost of the rental and gasoline will be billed directly with no mark -up. 3. Air transportation fees are billed directly with no mark -up.
