AN ORDINANCE AMENDING ORDINANCE No. 4990 -68,
AS AMENDED, COMMONLY KNOWN AS THE ZONING
ORDINANCE OF THE CITY OF SOUTH BEND, INDIANA
(Chapter 21, Municipal Code).
BE IT ORDAINED BY the Common Council of the City
of South Bend, Indiana:
Section 1. Ordinance No. 4990 -68, as amended,
which ordinance is commonly known as the Zoning Ordinance of the
City of South Bend, Indiana, be and the same hereby is amended in
order that the zoning classification of the following described
real estate in the City of South Bend, St. Joseph County, State
of Indiana:
B- Residential
A lot or parcel of land in the Southwest 1/4 of Section
33, TWP. 38 -N, Range 2 -E, described as follows: -
BEGINNING at the intersection of the west line of said
Section 33 with the Southerly line of Lincoln Way West
(U. S. Highway No. 20) formerly the Michigan Road; thence
southeasterly along the Southerly line of said Lincoln Way
West a distance of 1.487.3 feet for the point of beginning
of the land herein described; then South 282.4 feet;
thence east 200 feet; thence north 200 feet to the
southerly line of said Lincoln Way West; thence north-
westerly along the southerly line of Lincoln Way West, a
distance of 217.14 feet to the place of beginning, now
within and a part of the City of South Bend, St. Joseph
County, Indiana.
A - Residential
A lot or parcel of land in the Southwest 1/4 of the South-
west 1/4 of Section 33, TWP 38 North, Range 2 East described
as beginning on the South line of Section 33 at a point 1105
feet east of the Southwest corner of said Section 33; thence
North on a line parallel with the West line of said Section
33 a distance of 428.31 feet; thence east 198.45 feet;
thence South on a line parallel with the West line of said
Section 33, a distance of 428.31 feet, more or less to the
South line of said Section; thence West 198.45 feet to the
place of beginning, in St. Joseph County, Indiana.

Section 2. This Ordinance shall be in full force
and effect from and after its passage by the Common Council, approval
by the Mayor and legal publication.

to amend the Zoning Ordinance of the City of South Bend as hereinafter
requested, and in support of this application, the following facts are
shown:

Gentlemen:
The attached rezoning petition Of Dennis A, Wlega.nd
was legally advertised April 9, 1977. The Area Flan Commission
gave it a public hearing on April 19, 1977, at which time the
following action was taken:
"Upon a motion by William Limerick, being seconded
by Joseph Simeri and unanimously carried, the
petition, as amended, of Dennis A. Wiegand, for
Beacon Bowl, to zone from "A" Residential, and "B"
Residential, "A" Height and Area, to "C" Commercial,
"C" Height and Area, property located at 4210 Lincolnway
West, City of South Bend, is returned to the Common
Council with a favorable recommendation, subject to
final site plan approval."

STAFF REPORT
DENNIS WIEGAND (BEACON BOWL) - #526 -77
LOCATION - this site is located on the South side of Lincoln Way
West (U. S. 20), approximately 1,200 feet West of Sheridan
Avenue. The site is also approximately 1,200 feet East of
the entrance of the Michiana Regional Airport.
EXISTING ZONING OF THE SURROUNDING PROPERTY - the property to the
North of the site is currently zoned "C" Commercial and "D"
Light Industrial. The property to the East is zoned "C"
Commercial and "B" Residential and the property to the
South is zoned "A" Residential. The property to the West
is in St. Joseph County and is zoned "C" Commercial and
"R" Residential.
EXISTING LAND USE OF THE SURROUNDING PROPERTY - the property to the
North of the site is currently being used for a branch bank
facility and an office building. The property to the
Fast is being used for a restaurant and gas station. The
property to the South for single family houses and the new
Dickenson Middle School and the property to the West is
being used for various commercial uses, as well as some
single family houses.
SITE PLAN - the site plan proposes an addition to the existing
Beacon Bowl facility. The owner is proposing the addition
of 20 lanes and the required parking facilities.
No other land uses are shown on the site plan.
ACCESS - access to the site will not be changed from its current
design. No State or local approvals will be needed for
the existing drives.
DRAINAGE - the City Engineer has indicated that the preliminary
design for the storm water retention is adeauate, however,
he has requested additional information be provided prior
to final site plan approval.
PARKING - the parking shown on the site plan is sufficient to meet
the requirements of the South Bend Zoning Ordinance.
TABULATED DATA - no tabulated data has been provided.
PRELIMINARY SITE PLAN - the site plan as submitted does not have
sufficient data to be considered a final, therefore, any
recommendation by the Area Plan Commission to the City
Council must be subject to a final site plan.
AGENCY COMMENTS - Mr. Patrick McMahon, Director, Department of
Public Works has reviewed this site plan and in addition
to the comments made on the drainage, has stated the
following:

1. City sewer and water are available to the site.
2. The 316 parking spaces shown on the plans
are adequate.
3. From the attached drawing it appears that no
additional access is requested by the petitioner.
It is noted that no additional access is required
by this office.
STAFF COMMENTS - this area has been designated as General Commercial
on the Land Use and Transportation Plan.
