AN ORDINANCE AMENDING ORDINANCE NO. 4990 -68, AS
AMENDED, COMMONLY KNOWN AS THE ZONING ORDINANCE OF
THE CITY OF SOUTH BEND, INDIANA, (Chapter 21, Municipal Code).
BE IT ORDAINED by the Common Council of the City of South
Bend, Indiana:
Section 1. Ordinance No. 4990 -68, as amended, which ordinance
is commonly known as the Zoning Ordinance of the City of South Bend,
Indiana, be and the same hereby is amended in order that the zoning
classification of the following described real estate in the City of
South Bend, St. Joseph County, State of Indiana:
A parcel of land in the East 1/2 of Section 2, Township 37
North, Range 2 East, Portage Township, St. Joseph County,
Indiana, more particularly described as follows:
Lots 1 through 19 of the First Plat of Shetterley
Place on the East side of Leland Avenue and North
of Portage Avenue.
Lots 2 through 16, 18 through 37, 48 through 59 and
the Vacated Alley between lots 55 and 56 in the First
Plat of Chapin Place located on the West side of
Forest Avenue and North of Portage Avenue; East side
of Forest Avenue and North of Manitou Place and
bounded by Manitou Place on the North, Forest Avenue
on the West and Lamont Terrace on the South.
Lots 43 through 52 in the Henrick and Grant Addition
located on the North and South sides of Marion Street
and bounded by William Street on the West and Madison
Street on the South.
Lots 1 through 5 in Burrough's Subdivision of Outlot
115 bounded by Navarre Street on the North and William
Street on the West.

Section 2. Ordinance No. 4990 -68 is further amended in
order that the Height and Area District of the following described
real estate in the City of South Bend, St. Joseph County, State of Indiana:
A parcel of land in the East 1/2 of Section 2, Township 37
North, Range 2 East, Portage Township, St. Joseph County,
Indiana, more particularly described as follows:
The Northerly 33.33 feet of Lot 6 of C. Fassnacht
Addition and the Southerly 30 feet and Westerly 78
feet of Lot 7 of C. Fassnacht Addition.
Lots 53 and 54 of Henrick and Grant Addition located
on the Northeast corner of William Street and Marion
Street.
A parcel of land in the West 1/2 of Section 1, Township 37
North, Range 2 East, Portage Township, St. Joseph County,
Indiana, more particularly described as follows:
Lots 15 through 19 in Reynold's Addition located on
the Southeast corner of Lafayette Boulevard and
Bartlett Street.
Lots 364 through 372, 181 through 185, 193 through
198, and 205 through 210 in the Original Plat of
South Bend located on the East and West sides of

Gentlemen:
The attached rezoning petition initiated by Joseph
Serge, a City Councilman, was legally advertised on September
11, 1976. The Area Plan Commission gave it a public hearing
on September 21, 1976, at which time the following action was
taken:
"Upon a motion by Joseph Serge, being seconded by
June Stratton and unanimously carried, the petition
initiated by Joseph Serge, a City Councilman, to
zone from "B" Residential, "C" Commercial and
"C -1" Commercial, "B", "C", "D ", and "E" Height and
Area, to "A" Residential, "A" Height and Area,
property bounded on the north by the St. Joseph
River, on the west by Leland Avenue, Portage Avenue
and Williams Street, on the south by Madison Street,
on the east by the alley between Main Street and
Lafayette Boulevard to Bartlett Street and west
to Lafayette Boulevard and north on Lafayette
Boulevard to the St. Joseph River, City of South
Bend, is returned to the Common Council, with a
favorable recommendation."

PARK AVENUE NEIGHBORIIOOD REZONING
CHRONOLOGY
July 22, 1976 -; The Park Avenue Neighborhood Association
addressed a letter to Roger Parent requesting that the
Common Council and the City administration give consideration
to the Association's request to rezone the Park Avenue
neighborhood to "A" Residential.
August 10, 1976 - Roger Parent directed the Area Plan
Commission staff to study the PANA proposal, to refine
it with members of PANA, and to draft an ordinance for
introduction by First District Councilman Joe Serge.
August 23, 1976 - First reading of the proposed ordinance.
