GAMMON Approved and signed by me ORDINANCE NO. 61 ?q -17 AN ORDINANCE REPEALING ORDINANCE NO. 5339 -71 PASSED SEPTEMBER 27,1971 WHICH ANNEXED TO THE MUNICIPAL CITY OF SOUTH BEND, INDIANA CERTAIN TERRITORY DESCRIBED AS LYING GENERALLY WEST OF HICKORY ROAD, SOUTH OF THE TOLL ROAD, EAST OF IVY ROAD AND NORTH OF THE PRESENT CITY LIMITS, AS AMENDED, AND COMMONLY KNOWN AS MAPLE LANE. STATEMENT OF PURPOSE AND INTENT The City of South Bend by Ordinance No. 5339 -71 passed by the Common Council on September 27, 1971 and approved and signed by the Mayor on September 30, 1971 annexed to the Municipal City of South Bend approximately 950 acres of land described as lying generally west of Hickory Road, South of the Toll Road, Ea.st of Ivy Road and North of the present city limits, and commonly known and described as Maple Lane. Remonstrance was filed to said Ordinance within sixty (60) days after the last publication of said Ordinance by a majority of the owners of land in the territory and that said remonstrance is currently pend- ing for a hearing in St. Joseph Superior Court, Cause No. F -786. Since that time, the City of South Bend has determined that it would be in the best interest of the City not to pursue said annexation and remonstrance further, and that said annexation ordinance should now be repealed. NOW, THEREFORE, BE IT ORDAINED BY THE COMMON COUNCIL OF THE CITY OF SOUTH BEND: SECTION I. That Ordinance No. 5339 -71 passed by the Common Council on September 27, 1971 approved and signed by the Mayor on September 30, 1971 is hereby repealed. SECTION II. At Large Over the past several years, the need to take more rea- listic approaches to urban problems has become more and more apparent. The time has come for the Council to take the lead in evaluating annexations in light of all persons con- cerned. In re- evaluating the Maple Lane annexation, it appears that if we would proceed ahead, it would result in the pre- sent citizens of the City of South Bend subsidizing the an- nexed area. The additional costs for the operation and main- tenance of the almost 19 miles of public streets and the annual cost of providing street lighting would be substantial. The Drainage Study for this area calls for a complete separation of storm and sanitary sewers. The recent reports regarding pollution problems near and _around Juday Creek and the det- eriorating sewer systems again call for substantial monetary investment just to bring them up to minimum city standards. Since all of us should be concerned about enhancing the quality of life in our neighborhoods, it would be in everyone's best interest not to proceed ahead with this annexation. Instead, we should begin providing forums for all town- ship and city residents and elected officials to discuss and exchange our goals, problems, and objectives in a renewed spirit of cooperation.
