(-o °-f77 AN ORDINANCE AMENDING CHAPTER 2, ARTICLE 16 AND ARTICLE 17 OF THE MUNICIPAL CODE OF THE CITY OF SOUTH BEND, INDIANA, PERTAINING TO THE RULES AND REGULATIONS OF THE BOARD OF PUBLIC WORKS AND THE ADDITION OF AUTHORIZING THE TAKING OF SEALED PROPOSALS FOR INSURANCE COVERAGE OF THE CITY STATEMENT OF PURPOSE AND INTENT The Common Council of the City of South Bend passed Or- dinance No. 5957 -76 as amended on March 8, 1976. That ordinance established the mechanism by which the Board of Public Works would receive sealed proposals for the City's insurance coverage. However, a typographical error appeared in that ordinance in the chapter and article reference. Therefore this ordinance is introduced to make that correction and to clarify other portions of that ordinance. NOW, THEREFORE, BE IT ORDAINED by the Common Council of the City of South Bend, Indiana, as follows: SECTION I. Section 16 -2A entitled Board of Public Works, rules and regulations and Section 16 -2B entitled Board of Public Works; purchase of all city insurance by competitive bids of the Municipal Code of the City of South Bend shall be deleted in their entireties. SECTION II. Chapter 2, Article 16 of the Municipal Code of theCity of South Bend, Indiana is hereby amended to read in its entirety as follows: SEC. 2 -16. Board of Public Works; rules and regulations.11a (a) The Board of Public Works shall promulgate such rules and regulations as may be necessary to carry into effect- the operation and intent of this Chapter. (b) The Board shall promulgate such rules and regulations as may be necessary to carry into effect the operation and intent of the powers and duties mandated by State law. SECTION III. Chapter 2, Article 17 of the Municipal Code of theCity of South Bend, Indiana, is hereby amended to read in its entirety as follows: SEC. 2 -17. Board of Public Works; purchase of all city insurance by sealed proposals.11b (a) The Board of Public Works shall have the authority to purchase such insurance to cover the liability of the city as may be necessary to carry out the provisions and intent of this Chapter. (b) All contracts for insurance coverage shall be subject to sealed proposals. (c) Complete specifications for such insurance shall be approved by a committee whose members shall include the City Attorney, Controller, Deputy Controller, and Chairman of the Common Council's Committee on _ Personnel and Finance. Specifications shall be filed with the Clerk to the Board. (d) The Board shall cause to be published for two (2) weeks,: once each week, in a newspaper of general circulation published in the city, a notice informing the public and pro- spective insurance companies of the general nature of the insurance coverage needed and of the facts that complete specifications are on file in such office, and calling for sealed proposals for such coverage by a day not earlier than one hundred twenty (120) days after the last of such publications. (e) The Board shall require each insurance company to file with such Board an affidavit that such company has not directly or indirectly entered into any combination, collusion, undertaking or agreement with any othEr company or any other person with reference to such proposals in any way or manner whatever. (f) Upon proper money appropriation by ordinance, the Board shall, if a satisfactory proposal be received, let such con- tract to the lowest or best proposal. SECTION IV. DOMBROWSKI on March 8, 1976. You will recall that that ordinance At Large FRANK HORVATH established a system whereby all city insurance would At Large be sought by the Board of Public Works receiving sealed proposals from insurance companies. Unfortunately, the wrong chapter and article numbers were incorporated. Therefore, the new ordinance corrects this clerical error and also substitutes "sealed proposal" or "pro- posal" throughout the ordinance instead of the words "bid" or "bidder" for added clarification. Your favorable support on this amendment would be appreciated.
