BE IT ORDAINED BY THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA: Section 1; Ordinance No. 4990 -68, as amended, which ordinance is commonly known as the Zoning Ordinance of the City of South Bend, Indiana, be and the same hereby is amended in order that the zoning classification of the following described real estate in the City of South Bend, St. Joseph County, State of Indiana: Lot 10, Murphy's First Addition to the City of South Bend. be and the same hereby is established as "B" Residential and an "A" Height and Area District. Curry was legally advertised April 9, 1977. The Area Plan Commission gave it a public hearing on April 19, 1977, at which time the following action was taken: "Upon a motion by Joseph Simeri, being seconded by Daniel Chrzan and carried, the petition of Dr. Lawrence R. Curry, to zone from "A" Residential, "A" Height and Area, to "B" Residential, "A" Height and Area, property located at 3628 Edison Road, City of South Bend, is returned to the Common Council with a favorable recommendation, subject to final site plan approval° The above recommendation is made subject to a final site plan and the preliminary site plan is attached hereto. The deliberations of the Area Plan Commission are shown in the minutes and will be forwarded to you as soon as possible. CURRY #525 -77 LOCATION - this site is l6cated at the southwest corner of Edison and Hickory Roads. EXISTING ZONING OF THE SURROUNDING PROPERTY - the property to the north is partly in the City of South Bend and is zoned "A" Residential, and is partly in the City of Mishawaka and is zoned "C -1" Commercial. The property to the east is in the City of Mishawaka and is also zoned "C -1" Commercial. The property to the south and west is in the City of South Bend and is zoned "A" Residential. The property approximately 100 feet west of the site is currently zoned "B" Residential. EXISTING LAND USE OF THE SURROUNDING PROPERTY - the property to the north is currently being used for single family houses and there is some vacant land. The property to the east is being used for a convenience grocery store and single family houses. The property to the south and west is being used for single family houses. The property approxi- mately 100 feet west of the site is being used for a multi- family apartment complex. SITE PLAN - the site plan proposes to use the existing single family as a doctor's office. No new construction is indicated and no other land uses are shown on the site plan except for the required parking spaces. ACCESS - access to the site will be from one drive on Hickory Road. The site plan does not show a drive on Edison Road. No State approvals will be necessary, however, the City Engineer must approve the drive. DRAINAGE - all storm water will be retained on the site in a dry well. The detailed drainage plan must be approved by the City Engineer prior to final site plan approval. PARKING - the site plan shows five parking spaces, however, one space is in the 25 foot setback area. This problem can be solved by redesigning the parking area and this also must be done prior to the final site plan approval. TABULATED DATA - the site contains approximately 10,880 square feet with the building using approximately 1,670 square feet, the parking and drive using another 1,820 square feet, leaving approximately 7,390 square feet in open space. CURRY (cont'd) Page 2 PRELIMINARY SITE PLAN - the site plan as submitted does not have sufficient data to be considered a final, therefore, any recommendation by the Area Plan Commission to the City Council must be subject to a final site plan. AGENCY COMMENTS - Mr. Patrick M. McMahon, Director, Department of Public Works, has reviewed the site plan and made the following comments: 1. City water is available to the site. 2. There are no sanitary sewers available at this location. 3. There are no storm sewers available to this site. 4. Access to this site is subject to approval by the Bureau of Traffic and Lighting, of the City of South Bend STAFF COMMENTS - this area has been designated as Residential, Moderate Density on the Land Use and Transportation Plan.
