GAMMON Approved and signed by me -- 4 7t- - -1.. - Clerk West side of Logan St. North of Jefferson Blvd. ORDINANCE NO. 6219 -77 AN ORDINANCE AMENDING ORDINANCE NO. 4990 -68, AS AMENDED, COMMONLY KNOWN AS THE ZONING ORDINANCE OF THE CITY OF SOUTH BEND, INDIANA (CHAPTER 21, MUNICIPAL CODE). BE IT ORDAINED by the Common Council of the City of South Bend, Indiana: SECTION I. Ordinance No. 4990 -68, as amended, which ordinance is commonly known as the Zoning Ordinance of the City of South Bend, Indiana, be and the same hereby is amended in order that the zoning classification of the following described real estate in the City of South Bend, St. Joseph County, State of Indiana: Lots 20, 21, 22, and 23 of Belmont Addition to the City of South Bend be and the same is hereby established as "C" commercial "A" Height and Area. Subject to a final site plan, and to include redwood fencing on the west. SECTION II. This Ordinance shall be in full force and effect from and after its passage by the Common Council, approval by the Mayor and legal publication. JOHNSON Executive Director (219) 284 -9571 August 17, 1977 In Re: A proposed ordinance and site development plan of Yeager - Brown, Inc. to zone from "R" Residential, "A" Height and Area, to "C" Commercial, "A" Height and Area, property located on the west side of Logan Street and north of Jefferson Boulevard, City of South Bend Gentlemen: The attached rezoning petition of Yeager- Brown, Inc. was legally advertised August 6, 1977. The Area Plan Commission gave it a public hearing on August 16, 1977 at which time the following action was taken: "Upon a motion by Joseph Simeri, being seconded by Joseph Serge and carried with Michael Miles abstaining, the petition of Yeager- Brown, Inc., to zone from "R" Residential, "A" Height and Area, to "C" Commercial, "A" Height and Area, property located on the west side of Logan Street and north of Jefferson Boulevard, City of South Bend, is returned to the Common Council with an unfavorable recommendation as it is their feeling it is a needless extension and intrusion of a commercial use into a residential area." If the Council should rezone this site, it shall have to be subject to the submission of a final site plan. EXISTING LAND USE AND ZONING: Vacant - "R" Residential, "A" Height and Area SURROUNDING LAND USE AND ZONING: North: Single Family "R" Residential, City of South Bend East: Single Family and "C -1" Commercial, City of Pharmacy Mishawaka South: Vacant and Filing Station "R" Residential and "C" Commercial West: Single Family "R" Residential LAND USE AND TRANSPORTATION: Residential Moderate Density APPLICABLE REGULATION: Restaurant is a permitted use in "C" Commercial. 1 parking space per 3 people at maximum design capacity. A continuous visual screen for all parking areas. ACCESS: Is shown as off Marshall and Logan. DRAINAGE: Is shown using storm sewers. PARKING: 19 parking spaces provided, ordinance requires 15. TABULATED DATA: Building 1525 sq. ft. Open space 15,275 sq.ft. Total 16,800 sq. ft. SITE PLAN: Parking space size does not conform with ordinance. Must be considered preliminary. AGENCY COMMENTS: City Sanitary Sewers and City Water are available to the site. Storm water piped to 36th Street basin. STAFF COMMENTS: Parking space size must be altered. Adequate screening and landscaping must be provided on the west, south and north sides of parking area.
