ORDINANCE NO. 6219 -77
AN ORDINANCE AMENDING ORDINANCE NO. 4990 -68,
AS AMENDED, COMMONLY KNOWN AS THE ZONING
ORDINANCE OF THE CITY OF SOUTH BEND, INDIANA
(CHAPTER 21, MUNICIPAL CODE).
BE IT ORDAINED by the Common Council of the City of South Bend,
Indiana:
SECTION I. Ordinance No. 4990 -68, as amended, which ordinance
is commonly known as the Zoning Ordinance of the City of South Bend,
Indiana, be and the same hereby is amended in order that the zoning
classification of the following described real estate in the City
of South Bend, St. Joseph County, State of Indiana:
Lots 20, 21, 22, and 23 of Belmont Addition to the City of
South Bend
be and the same is hereby established as "C" commercial "A" Height
and Area. Subject to a final site plan, and to include redwood
fencing on the west.
SECTION II. This Ordinance shall be in full force and effect
from and after its passage by the Common Council, approval by the
Mayor and legal publication.

In Re: A proposed ordinance and site development plan of
Yeager - Brown, Inc. to zone from "R" Residential,
"A" Height and Area, to "C" Commercial, "A" Height
and Area, property located on the west side of Logan
Street and north of Jefferson Boulevard, City of
South Bend
Gentlemen:
The attached rezoning petition of Yeager- Brown, Inc.
was legally advertised August 6, 1977. The Area Plan Commission
gave it a public hearing on August 16, 1977 at which time the
following action was taken:
"Upon a motion by Joseph Simeri, being seconded by
Joseph Serge and carried with Michael Miles abstaining,
the petition of Yeager- Brown, Inc., to zone from "R"
Residential, "A" Height and Area, to "C" Commercial,
"A" Height and Area, property located on the west
side of Logan Street and north of Jefferson Boulevard,
City of South Bend, is returned to the Common Council
with an unfavorable recommendation as it is their
feeling it is a needless extension and intrusion
of a commercial use into a residential area."
If the Council should rezone this site, it shall
have to be subject to the submission of a final site plan.
The deliberations of the Area Plan Commission and
points considered in arriving at the ,a clacision are shown
in minutes of the public hearing and ftKJa #F"CE to
you at a later date to be made a part of this report.

AGENCY COMMENTS: City Sanitary Sewers and City Water are available
to the site. Storm water piped to 36th Street basin.
STAFF COMMENTS: Parking space size must be altered. Adequate
screening and landscaping must be provided on
the west, south and north sides of parking area.
