GAMMON Approved and signed by me A A , C2 -10477 ORDINANCE NO. to i27Y- 77 AN ORDINANCE APPROPRIATING $92,985.00 FROM WATER WORKS BUDGET FUND 30 DEPRECIATION FUND INTO LINE ITEM 710 BUILDINGS, STRUCTURES AND IMPROVEMENTS. STATEMENT OF PURPOSE AND INTENT: The Common Council on September 12, 1977 approved the Fifth Amendment to a contract entered into March 22, 1965 between Clay Utilities, Inc. and the City of South Bend, which amendment provided that if certain lease - purchase agreements between the City of South Bend and Clay Development Corp. and Clay Utilities, Inc. are executed, the City will purchase from Clay Development Corp., as assignee of Clay Utilities, Inc. certain wells and land heretofore purchased by Clay from Aqua, Inc. together with such additions, improvements, betterments, appurtenances, inter- connect and booster station at the price of $92,985.00. The said lease - purchase contracts have been approved by the Council and executed and the City should now proceed with the purchase of the herein stated facilities. NOW, THEREFORE, BE IT ORDAINED BY THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA, AS FOLLOWS: SECTION I. The sum of $92,985.00 is hereby appropriated from South Bend City Water Works Budget Fund 30, being the Depreciation Fund, into Line Item 710 for buildings, structures, and improvements. SECTION II. Parker Chief Deputy Members of the Common Council 4th Floor Council Chambers County -City Building South Bend, Indiana Dear Council Members: On September 12, 1977 the Common Council approved the Fifth Amendment to the contract originally entered into between Clay Utilities, Inc. and the City of South Bend on March 22, 1965. This amendment provided that if certain lease - purchase agreements between the City and Clay were executed, the City would purchase from Clay the water pumping facilities commonly referred to as Aqua, Inc. at a purchase price of $92,985.00. This purchase should now be completed and the attached ordinance provides for an appropriation of funds from the Water Works Depreciation fund into the Water Works budget item for buildings, structures and improvements.
