AN ORDINANCE AMENDING ORDINANCE NO. 4990 -68,
AS AMENDED, COMMONLY KNOWN AS THE ZONING
ORDINANCE OF THE CITY OF SOUTH BEND, INDIANA
(Chapter 21, Municipal Code).
BE IT ORDAINED by the Common Council of the City of South Bend,
Indiana:
Section 1. Ordinance No. 4990 -68, as amended, which ordinance is
commonly known as the Zoning Ordinance of the City of South Bend, Indiana,
be and the same is hereby amended in order that the zoning classification
of the following described real estate in the City of South Bend, St.
Joseph County, State of Indiana:
A parcel of land in the East Half of the East Half of Section 28,
Township 38 North, Range 2 East, German Township, St. Joseph
County, Indiana, described as follows:
Beginning at the intersection of the East line of said
Section 28 and the South right -of -way line of Cleveland
Road; thence Northwest and West along said South right-
of-way line to the West line of the East Half of the East
Half of said Section 28; thence South along said West
line, being parallel with and 660 feet West of the East
line of said Section 28, 2398.,97 feet to the East -West
centerline of said Section 28; thence West along said
East -West centerline 330 feet; thence South along aline,.
being parallel with and 990 feet West of the.East line of
said Section 28, to the centerline of the Chicago -South
Shore and South Bend Railroad; thence East and Southeast
along said centerline of Railroad to the East line of said
Section 28; thence North along said East line to the place
of beginning.
A parcel of land in the Northwest Quarter of the Northwest Quarter
of Section 27, Township 38 North, Range 2 East, German Township,
St. Joseph County, Indiana, described as follows:
A parcel of land bounded by a line on the Southeast by
Maple Road (Bendix Drive), on the Northeast by Cleveland
Road and on the West by the West line of said Section 27.
be and the same is hereby established as "D" Light Industrial, "A Height
and Area use district.
Section 2. This Ordinance shall be in full force and effect from
and after its passage by the Common Council, approval by the Mayor, and
legal publication.

In Re: A proposed ordinance and site development plan
initiated by Joseph T. Serge, to zone from "E"
Heavy Industrial, "A" Height and Area, to "D"
Light Industrial, "A" Height and Area, property
located west of Maple Road (Bendix Drive), south
of Cleveland Road, and north of the Chicago -South
Shore and South Bend Railroad, City of South Bend
Gentlemen:
The attached rezoning petition of Joseph T. Serge
was legally advertised October 8, 1977. The Area Plan Commission
gave it a public hearing on October 18, 1977, at which time
the following action was taken:
"Upon a motion by Patrick McMahon, being seconded
by Kenneth Woods and unanimously carried, the petition
initiated by Joseph T. Serge to zone from "E" Heavy
Industrial, "A" Height and Area, to "D" Light
Industrial, "Al' Height and Area, property located
west of Maple Road (Bendix Drive), south of Cleveland
Road, and north of the Chicago -South Shore and
South Bend Railroad, City of South Bend, is returned
to the Common Council with a favorable recommendation,
by the Area Plan Commission."
The deliberations of the Area Plan Commission and
points considered in arriving at the above decision are shown
in minutes of the public hearing and will be forwarded to
you at a later date to be made a part of this report.
Attached for your consideration in the review of this matter
is a copy of the Area Plan Commission Staff Report.
